"I've had my house listed for (7) seven damn freakin' months now!!! My 'so-called' Realtor put a sign in the yard and I haven't seen him/her since. I call and I call but it all goes straight to voice-mail!
After this long of having it Listed you'd think the sign on the left would look like the sign on the right!
I want out of this Listing...what can I do?"
Tracey Thomas (CA Realtor & Broker Associate) from BlogCalabasas.com shares her insights with us in an article titled: Insanity: Doing the Same Thing Over and Over and Expecting Different Results!
And believe me the title is appropriate...what you don't want to do is List your home with another Agent only to wind up in this position again (3) three - (6) six months down the line. But on to what's important...
"How the heck can I get out of this Listing?"
"Here in CA we have standardized forms called WINForms for real estate. There is a CA form called a 'Cancellation of Listing' fondly referred to as the COL... If you are considering canceling your listing agreement, it is important that you read this form thoroughly and make sure that you understand exactly what you are agreeing to." -- Tracey Thomas
So if you want/need to cancel your Listing and you're looking for less stressful days on market, you need to

Lots of agents out there got on board for the quick buck when the market was up. No training, no experience, no marketing savey. Sounds like Tracey has all three.
And it's very important to pick the right agent, two things. Will that agent still be working full time in the business for you after they take the listing or be in some other business just to make it right now? And two even if you wanted out of your contract make sure you inform your prospective new agent that you're still listed before they commit to time away from their existing clients. Case in Point 5 properties 1 Seller all currently listed. 5 hours wasted and $20 in gas.
I agree! It seems as if a lot of agents got on board during the boom when all they had to do was put a sign in the yard and get out the wheelbarrow to haul the money. Now they have to ?WORK? for the money. Hopefully, the swing of the pendulum will take these people out!
Deb: she most certainly does! That's not to say that other Agents here on the network don't but Tracey Thomas did bring up a very important topic!
Thanks for stopping by!
David: Both valid points that you're sharing! [Finding the Right Agent] shall be a post for another day.
Michael: I think the swing on the pendulum already has and is continuing to do so. As for getting the home sold NOW... a sign and a prayer won't do it! So this information is for those individuals that are looking for something better; how to get their home sold through good ol' work ethic and turnkey marketing. But first...let's get outta that listing!
That agent might have just let the business and never told any of his/her clients. We have seen whole offices close and no notice given to any of the sellers.
You have some great links on there Ricardo. Thanks!
Steve: you said,
Now instances like this I find unbelievable but yes it's true. All I can say is, think of it this way, more market share for us! Unfortunately the consumer has to suffer during the transition...then again this post addresses how to manage the situation.
Kris: I'm sure other States and Cities have their variation of this form. Unfortunately this one only addresses CA. Tracey Thomas works the Calabasas area.
