Onerous New "Point of Sale" Bill Now Pending in State Assembly!
The State Assembly here in California is busy trying to do all the right things for the citizens that live here when it comes to conserving energy. In their quest to be sure that we begin conserving energy now, our legislators here in California have this new idea that we should all have an Energy Audit and to take it one step further , even to make it mandatory that we all do it just in time to sell our homes to another Buyer that doesn't yet have an understanding of what energy conservation is. AB 2678 (Núñez) which among other things, requires that ALL homes and commercial property in California have an energy audit at point-of-sale and that mandatory energy efficiency investments be made.
As well intended as this might be, such mandates will even further erode and weaken the housing market. If enacted, AB 2678 could also add potentially thousands of dollars to the cost of selling or purchasing a home, including hundreds of dollars just to have a home audited. Now , what we all need is to waste a lot more paper, time and energy with yet another disclosure and report. Not to mention whatever the energy efficiency investments would be. Perhaps a new cottage industry the legislators are encouraging. Maybe this is what is meant by encouraging new business here in California?
Now, I don't know about you but there must be a better way to encourage energy conversation than these onerous point of sale mandates. Well intended most likely but just wrong.

This is an example of the "left state" once again trying to over the top. It's one thing to offer stimulus packages and even incentives such as tax rebates, but making things mandatory (which means you're a criminal if you don't comply) is wrong-headed and destined to backfire with the public. I could never get that about the CA government; they have probably the most progressive population in the country, but they insist on dampening private market development and favoring government regulation...
Well said Jeff and you are right. I don't expect the governor to sign this bill but his term will up in the not to distant future and then these bills will surface again and again until they become law. Onerous is not even a big enough word for all this. Intrusive might be a better description?
Jeff. Follow the money. Which companies, business segment would benefit from these "energy efficient" mandates?? What is the connection between the sponsors of the legislation and these companies???

I am all for energy savings, and conservation, but this is not the time or place. Point of sale? Come on! How about more and better incentives for going green in other areas of our lives- building, cars, etc. Let's recycle more, drive less, get better public transportation (especially here in the greater Los Angeles area). Hi Joan-They do don't they-have a way of spreading. Our Legislators just seem to have a hankering for this point of sale stuff. been going on for years and years and they just keep trying to pass these onerous mandates. Thankfully up to now we have had a Governor that won't agree. In the next election, it seems all but certain the party elected will be an extension of the current legislators and these types of bills will increase and get passed with NO opposition. The citizens of CA will then get exactly what they voted for and they will then have to learn to deal with it.

Hi Teri, That is an interesting visual,lol. But probably right. Who thinks these things up. Wouldn't you love to see the contact that was made to induce the creation of the bill and then the defense that gives the legislators the courage to think it could ever work like it was illustrated to them. What shade of stupid do suppose that is?

Hi Roberta, Heck no! But you could be Governor and I could serve in you cabinet. It would be sighted guiding the gifted and we could accomplish a whole world of change together. If we would fail miserably, we would still be better than what we got.lol
William - It sounds too political to me. I don't get it. There have to be better ways to encourage energy conservation strategies. This makes no sense to me at all. Great for the politicos who are looking to their future, but does this really make sense?? C.A.R. is encouraging all to oppose this - I have to agree.

Hi Jeff, These things have been proposed for years and we have been fighting them as long. The successful one was imposed by the city of San Diego, the water retrofit ordinance. The last one defeated was the solar energy retrofit at point of sale. They just keep coming back.
