There is a new government foreclosure prevention program for owner occupants that you may want to consider. It is the HAFA short sale program. This program is effective through December 31, 2012. If you are eligible, the HAFA program will provide the seller with up to $3,000 in cash at closing for partcipating in the program in additional to speeding up the process of a traditional short sale. HAFA Short Sale Benefits for the seller include:

• Approval is supposed to be issued within 10 days. (Usually takes a little bit longer however but not nearly as long as a typical short sale)
• Lender/Servicer will agree not to foreclose for a period of up to six months to allow time for the sellers agent to market the property, obtain an offer and complete the HAFA short sale process.
• The lender/servicer will agree to give up their right to seek a deficiency judgement against the seller.
• A full release for the Seller of all current and future liability from the home mortgage.
• Seller will not be required to come up with any funds for a seller contribution to close.
• The seller may be eligible to receive up to $3000 in relocation assistance funds upon a successful completion of a HAFA short sale.
