Last night a visitor to WeKnowUrban left a scathing comment about the brand new midtown Phoenix high rise condo project, Century Plaza.
We don't know if the allegations are true. However, I personally have had what I consider strange experiences with the developer with respect to Certificates of Occupancy as I too am under contract for the purchase of a condo at Century Plaza.
On August 14th I received a letter from the developer asking me to schedule my closing date. That same day I sent a fax to the broker of the project asking for proof that they had received a permanent Certificate of Occupancy for both the condo for which I am under contract AND the common area in general. I did not hear back from them until August 21st when I received a certified letter stating that if I did not close within 48 hours of the date of the letter then they would consider me in default and basically take my earnest money (NOTE: I did not receive the letter until four days after the deadline date). I immediately responded and again requested proof of the Certificates of Occupancy and have not yet heard from the company.
To be fair I have not yet obtained a loan for the property (loans are EXTREMELY difficult to obtain in todays lending environement) so perhaps the developer is not taking my requests for C of O's seriously. Nonetheless, my experiences coupled with PhxBabe's comments leads me to wonder what the rest of the story might be. Certainly, it seems that a cursory look on the part of the City of Phoenix might be in order.

Too many questions in regards to this project. Lovely project but pricing needs to reflect current market conditions. So far it seems their inflexability could be their weakness. M.
Even if/when final COs are obtained, I would question what's behind the walls here since they are trying so hard to push the closing issues prematurely. Plus, why is Equus trying to get buyers to sign an "addenudum" (at closing time, no less) that basically releases them from responsiblity/liablity of problems after closing? Do they know something we don't...they seem to be trying real hard to "cover their A's". Here's what it says: "Except as noted on the Final (walkthrough) List, the Buyer accepts the Property as is, and acknowledges that from this date forward the Buyer will have no claim against the Seller for any item that was not listed on the Final List even if said item not listed could have been ascertained or observed during the Buyer's Walk Through. The Buyer understands that in exchange for the Limited Warranty Agreement and the other provisions of the Contract with the Seller the Buyer will have no right to recover or receive compensation for any incidental, consequential, secondary, punitive, or special damages, nor any damages for aggravation, pain and suffering, mental anguish, or emotional distress, nor any costs or attorney's fees. This provision shall be enforceable to the extent allowed by law."
As one potential buyer stated, "I wouldn't sign a document like that if you put a gun to my head!"

I'm an interested condo owner. What is the basis for the lawsuit?
INVESTORS withoout
INVESTORS without wherewithall or inclination to close band together to get their earnest money back!
Is there a problem with the bulding?
No. It is excellent (go see for yourself)
Did the developer not deliver what they promised?
No. They did everything and more.
SO WHAT IS THE PROBLEM??
Answer: These INVESTORS (many of whom LIED about that fact when they signed their purchase contracts) are only in it for the money and they are simply backing out of their purchase commitment and now are trying to get their money back.
And, to top it off, they are going around talking smack about the building! SHAMEFUL!
This is truly disappointing to me. As someone who claims to "love" the downtown/midtown phoenix area, I can't believe you're allowing these slanderous posts to continue. I live in Century Plaza and it's fabulous. The building is spectacular, the location is unmatched, and the amenities are seemingly never-ending! The accusations that these people are making are laughable! Rather than trying to discourage people from purchasing here for your own personal gain or agenda, why not try living up to what you claim to be, someone who loves this city and wants the revitalization effort to continue.
I used to frequent your site regularly in my quest for information on the downtown/midtown market, and I found it very helpful. However, your recent support of "Investors" aka people who do not plan on living in the building and are SOLELY motivated by profit and an attempt at a quick flip, and in my opinion are the major factor in what caused the market to crash, has prompted me to look elsewhere.
It's a shame. Please let me know if/when your conscience returns.
To Century Plaza Resident: how do you feel about the project being taken over by a receiver as result ot the developer not paying its construction loan?

You offer, above, a reason for the bank's imposition of a receiver but your reason is wrong. The fact is, you have NO IDEA why the bank put a receiver in place! I happen to know the truth of the matter (and the truth is reasonable and actually fairly innocuous). But rather than seek the truth yourself (or listen to an actual RESIDENT of the building) you merely press hot buttons to forward your own twisted agenda.
Century Plaza is fine and it will remain so without regard to the receiver or your continuous disparaging commentary.

I am simply asking reasonable questions and sharing information. Your comments sound very emotional and exaggerated as if you are trying to protect your own interests.
I think it's pretty ironic that after more than 3 years of the developer totally ignoring the buyers and not communicating with them, he is now furiously trying to censor valid comments and problems/complaints that have been brought up by them. Even when contacted directly by a buyer, it would take a month or more (or not at all) to receive a response from the developer, as evidenced by "Real Story" (check it out at www.weknowurban.com/blog/phoenix-hi-rise-and-loft-condos/century-plaza-sued-by-buyers); this is from someone who wanted to LIVE there, not a vile INVESTOR. It also illustrates the discrepancy between the developers definition of "finished" and anyone with eyes (oh, sorry, I'm not supposed to notice the granite and cabinets were missing!). Also, Equus allowed and encouraged 20% investors in the project, so no one lied about it, the developer happily accepted vile investor money. "Century Plaza Resident", you sound suspiciously like an employee of Equus.
