SB 1062: For Sale Signs and the HOA's

Recently in Arizona, SB 1062 passed and has put more power into a home owner's hand, as it relinquished it from the HOA's (home owners associations). Before this bill if someone lived in an HOA that had bylaws restricting or forbidding for sale signs, they had no other choice but to follow the HOA's rules.

Since the passing of SB 1062, home owners were given the authority to place for sale signs in their yards or in their windows. However, for sale signs and name riders must comply with industry standard size. In SB 1062 standard size would mean a for sale sign is not exceed eighteen by twenty-four inches for signs, and name riders are not to exceed six by twenty-four inches.

In addition, home owners are also given the right to display the American Flag outside on their property. Yet, HOA's are still allowed to regulate the size, and location of the flagpoles. I guess if they can tell you what colors you can paint your house, or how tall a structure can be, they can make any other rule they dream of making.

Furthermore, political signs will be allowed to be placed on a home owner's property as long as long as it is not displayed more than forty-five days prior to an election, and no later than seven days after an election.

Moreover, SB 1062 does not apply to for rent signs, or the placement of for sale signs and directional signs on HOA's common areas.

In closing, I believe that Listing Brokers would be well advised to discuss the new law with their clients. If their questions remained unanswered, then the Listing Broker should advice their client to seek legal counsel.

Ulises, Thank you for the informative post.  HOAs being relatively new will most likely go through changes not only within communities, but also at the state level.  It has been very interesting watching them, and the laws evolve.

Kathleen: I think it is very interesting as well. I am still on the fence about HOA's, I know the pros and the cons, but I have yet to make a final decision if I am for or against them. Thanks for your post.
