GOT PROTECTION FROM REAL ESTATE TRANSFER TAXES?
HERE IS THE CITIZEN'S INITIATIVE THAT WILL PROTECT OUR HOMES!
Vote "YES" in NOVEMBER
- A "YES" Vote will prohibit the state, county and a city from double taxing your home through a real state transfer tax.
- A "NO" Vote will leave you without protection, meaning the state, county and a city could pass real estate transfer taxes on your home at any time damaging your hard earned equity.
Be it enacted by the People of the State of Arizona:
1. Article IX, Section 24, Constitution of Arizona is proposed to be added as follows if approved by the voters and on proclamation of the Governor:
ARTICLE IX, SECTION 24, PROHIBITION OF NEW REAL PROPERTY SALE OR TRANSFER TAXES THE STATE, ANY COUNTY, CITY, TOWN, MUNICIPALITY OR OTHER POLITICAL SUBDIVISION OF THE STATE, OR ANY DISTRICT CREATED BY LAW WITH AUTHORITY TO IMPOSE ANY TAX, FEE, STAMP REQUIREMENT OR OTHER ASSESSMENT, SHALL NOT IMPOSE ANY NEW TAX, FEE, STAMP REQUIREMENT OR OTHER ASSESSMENT, DIRECT OR INDIRECT, ON THE ACT OR PRIVILEGE OF SELLING, PURCHASING, GRANTING, ASSIGNING, TRANSFERRING, RECEIVING, OR OTHERWISE CONVEYING ANY INTEREST IN REAL PROPERTY. THIS SECTION DOES NOT APPLY TO ANY TAX, FEE, OR OTHER ASSESSMENT IN EXISTENCE ON DECEMBER 31, 2007.
2. The Secretary of State shall submit this amendment to the voters at the next general election as provided by Article XXI of the Arizona Constitution.
Summary for this Initiative Pursuant to A.R.S. § 19-102.
This Initiative prohibits the government from charging any new tax on the sale or transfer of real property in Arizona. Currently, there are no real property sales or transfer taxes in Arizona. However, the government could enact a real property sale or transfer tax at any time. This Initiative will prohibit the enactment of any new real property sales or transfer tax by a constitutional amendment.

Thanks for posting this, John. When they turned in the signatures needed to get this on the ballot, they had a record number. I can't remember what it was - but obviously this is another tax that is not needed in our State.
Not to mention, that sometimes it's a little confusing when a "yes" vote means "no". Thanks for clarifying that this is a measure to NOT have a transfer tax on real estate. We really need all Arizona residents to vote yes on this proposition.
I am ambivelent about this proposal. I'm not in favor of a transfer tax, but the legislature has never come close to passing one. If the Republicans who run this state could come up with a rational tax system that supported decent education and infrastructure, this kind of heavy-duty transfer tax wouldn't be necessary. Generally, I'm not in favor of proposals to amend the Constitution that reduce the flexibility of our elected representatives to govern in future situations. Keep the Constitution the why the founders wrote it -- it's worked!
