Compliance, Regulations and the DRE
During the month of April the DRE (Department of Real Estate) did a sweep through California and various other states and exposed many companies who were not in compliance under various state and federal guidelines. The DRE grants licenses to brokers, real estate agents, and now firms who assist homeowners through the banks standards for loan modifications. Every time someone refinances, buys or sells a home, and now modifies their existing obligation with their lender the DRE is involved...and for good reason. Over the past couple years many non-compliant firms were entering the market in order to capitalize on the growing economic disaster and a few bad apples ruined what was a savior industry for many Americans.
It's like this: there are handymen who work without a license, there are people who are going to be driving by you on the freeway today with a suspended license, or no license at all, its not to say that they can't drive, or that they can't help you re-roof your home, but they are not compliant, and answer to nobody if said work is not done properly. The most important thing to understand is that working with a non-compliant firm vs. one who is under pressure to perform according to government instituted guidelines is parallel to buying a new HD television from BestBuy versus purchasing a similar model from the local flee market. Who is going to support you if something goes wrong next week, next month, or next year?

Many of my new clients have in someway been victims of loan modification fraud, and it both angers and saddens me that anyone would take advantage of a persons misfortune and cause further hardship and try to pass off their accountability, some were taken advantage of in the same way the lenders and mortgage brokers tricked these same people years back by exploiting their lack of financial understanding, while some were simply stolen from by non-compliant firms who were gone as quickly as they sprang up.
