One of the issues that comes into play with buying a home in Chicago or anywhere in fact across this wild world, there is a silent issue and it is called encroaching or encroachment.
Here in Chicago sellers use attorneys to handle their real estate closings. But most attorneys never go to the subject property to see if there are any issues such as "encroachment."
Yup, this bush is encroaching into the Street. But it just doesn't have to do with a bush when buying a home .. the encroachment can be a tree, better yet, the overhang of the garage roof or the house roof into the neighbors yard because your neighbor owns the air space up, up there and if the overhang is encroaching your neighbors air apace, then you need to make sure that your title policy protects you with respect to that encrochment.
But I have a survey! Survey, Burvey, Curvey, doesn't matter. Generally, I have only seen surveys show where the buidling itself is encroachment just a tad (let's san 1/10 of and inch on your neighbors yard but never says anything about the roofline encroaching. Now this neighbor really doesn't give a care but what happens if he sells it to someone who isn't so nice that wants to know where his boundaries are and doesn't want anybody elses property encroaching on this lot or hanging over it!
Think I'm kidding? Right now, I have a senior citiizen that is on the war wagon because the next door neighbors tree limb hangs over into her lot and she is tired of raking up his leaves!!! Was this an issue before this neighbor bought it a couple years ago? Nope. She knew the next door neighbor and they were friends. But the tide changes all the time.
So, make sure that you tell your attorney or your real estate agent that if you see an encroachment on your property or vice versa, that it is handled in the proper manner for your protection under the title insurance policy.
