We've Come a Long Way, Baby: from FedEx to Fax to e-Signing

Do you remember using overnight mail for sending your offers out for signature? And a giant FedEx bill too! It was hundreds of dollars per month, but we justified the bill by saying, "we're saving time AND gas money by not having to drive around to get signatures".

I remember when the FAX machine came out and after a while, every real estate office had one. They used a long roll of thermal paper, which faded after a few weeks. It was soooo cool to hear the phone ring, see the fax connect, and watch an offer come through. Almost like magic! No more driving around to get offers signed. Only problem is that after the offer with its teeny-tiny font was faxed around 3 or 4 times, it was no longer legible.

Next came electronic online signatures. DocuSign led the way for real estate agents, but now many other companies also offer e-signing, such as www.GoPaperless. The best part is that you have a clear and legal signature stamp, it's signed quickly and hassle-free, and the you can actually read the documents because they're still clear and crisp (if every party e-signs).

What is an electronic signature?

An electronic signature is any legally recognized electronic means that indicates that a person adopts and agrees to the contents of an electronic message or electronic contract. An electronic signature is an electronic sound, symbol, or process, attached to or logically associated with a contract or other record and executed or adopted by a person with the intent to sign the record.

An electronic signature utilizes a mathematical scheme for demonstrating the authenticity of a digital message or document. A valid electronic signature gives a recipient reason to believe that the message was created by a known sender, and that it was not altered in transit. Electronic signatures are used with

Electronic signatures help to establish the following assurances:

Intent: Intent is an important aspect of the e-signature process because it provides the legal "context" for enforceability. The electronic signature process should always provide a "structured online setting" that takes the signer through a series of steps, which make it clear that they are signing a legal document and confirms intent through overt actions, such as creating their signature and applying it to specific locations in the document.

Authenticity: The electronic signature helps to assure that the signer is who he or she claims to be.

Integrity: The electronic signature helps to assure that the content has not been changed or tampered with since it was digitally signed.

Non-repudiation: The electronic signature helps to prove to all parties the origin of the signed content. "Repudiation" refers to the act of a signer's denying any association with the signed content.

Creston, CA: Country with a Twist

Rural Creston, CA lies about ten miles east of Atascadero in San Luis Obispo County, just south of Highway 41 on Highway 229. With a population of about 1100 people, Creston is a laid-back country town that you've probably never heard of, in the middle of cattle and horse country.

You get four seasons in Creston, though the winters are not extremely harsh. A sprinkling of snow may occur, but seldom an accumulation that lasts very long. But the crisp temperatures and frequent freezes reminds you that California isn't just about beaches. Summers are warm, and you'll definitely want air conditioning. The spring brings a wonderful wildflower show after winter rains.

Horse and cattle ranches abound, surrounding the center of Creston. Rolling hills dotted with oaks, chaparral, and grassy fields support wineries, agribusinesses, and small family farms.

Creston has two claims to fame, which may surprise you. One is that Dianetics writer and Scientology founder L. Ron Hubbard died there on a ranch he owned, in 1986. He had essentially retired from the church he founded and no longer was in charge of daily operations. He lived on a sizable ranch in Creston from 1983 until

creston l ron hubbard photo his death in 1986. He had let his hair grow long and was able to move through his daily routine in his neighborhood without anyone recognizing him. He died of a stroke, alone except for his doctor and lawyer. The ranch has since been deeded to the Church of Spiritual Technology (an offshoot of Scientology), and is occupied by caretakers who keep it in mint condition. Unfortunately, the ranch is not open for tours.

Another point of interest in Creston is the ranch once owned by television personality and Jeopardy host Alex Trebek, where he bred, raised, trained, and cared for Thoroughbred horses. He has since sold the farm, but lived there for several years.

Horse trailers, pickup trucks, and real cowboys are a common sight around Creston. And beautiful ranch parcels are available for a very reasonable price. Check it out!
