El Dorado Hills CA – I talk about “escalating” a short sale. To put that in perspective, I am going to give you a real life example of how it is done.

We had a house on the market for 5 months. We started the price at 425k and slowly brought it down to 375k. We received no offers for 5 months.

Then, we finally received an offer for 350k. Since we knew the bank’s appraised amount, we knew that offer wouldn't work.

The bank’s appraisal had come in around 390k. (We didn’t think that number was the real value because buyers weren’t doing anything at that price.)

We knew that that current offer at $159,000 didn't have a shot at getting accepted.

In order to get this file thru, we had two things to do.

1. Get a new, more accurate appraisal done.

2. Escalate the file.

To handle Part 1, we sent our own version of an appraisal to the lender. We explain to them why we did not think the appraisal was accurate and requested that they order a new one.

Then, we asked for their supervisor's contact info. The new appraisal came back at 380k. The buyer told the bank that they would pay 365k, but no more.

The bank accepted the buyer’s offer and we received an approval and the home sold a few weeks later. Thinking about a short sale?

El Dorado Hills CA – The biggest threat to your short sale is a high appraisal. Which is why your agent needs to make sure the appraisal is accurate.

There are a lot of opinions on how to ensure the appraisal is correct and accurate. You need to check and make sure your agent is willing to do the extra work.

I will tell you what happened to an agent that decided it was too much work. This agent decided not to do the extra work. Then, short sales started getting turned down for no reason at all.

This agent thought they were doing everything right. They couldn’t see how they were doing wrong. The buyers were only willing to offer so much and the bank only willing to accept so little.

The buyer’s offers were higher than the property would have sold for after being foreclosed on by the bank. So they kept turning down the buyer’s offers. “We think the house is worth 300k”, they would say.

“But, we think the house is worth 250k”, replied the buyers. The short sales became more and more difficult.

Here is the good news. Now this agent checks to make sure every single appraisal is accurate. Today most of their short sales are being approved.

El Dorado Hills CA – Short sales have a reputation for taking a long time. But, they can drag on even longer if the paperwork isn't submitted to the lender in a timely manner.

When the Stop Foreclosure Institute first started doing short sales, we were hesitant to submit anything to the lender until we had a 100% complete package.

That caused the short sales to drag out a lot longer. After a little while, we learned to submit the paperwork as quickly as possible to the lender.

It usually takes 30 to 60 days for the lender to assign a negotiator to the file. That gives us plenty of time to track down any missing paperwork.

We realized that we were wasting time if we waited 30 days until everything was perfect and then submitted the file. There is a common myth that you shouldn't submit short sale paperwork until it is 100% complete.

Let me explain why that myth just isn't true. A lot of lender have different special forms they wanted filled out specifically for them.

"Oh, you need the buyer and seller to sign the ABC Bank Contract Addendum", the short sale negotiator tells us. Besides, most short sale negotiators want things done certain a way.

Because of this it is almost impossible to put together a 100% perfect short sale file that will have exactly the way the lender wants it. So make sure your agent submits your file quickly and follows up with the short sale negotiator to see if anything is needed.

El Dorado Hills CA – Most people short selling their home do not want to repay the deficiency. And in most cases, the lender allows them to walk away with no deficiency.

But, that is not always the case. Some banks are very pushy when it comes to the deficiency. They won’t approve the short sale unless the borrower accepts a deficiency.

Some home sellers have told the Stop Foreclosure Institute that if the lender won’t approve the short sale without a deficiency, then they will simply allow them to foreclose on the property.

This seems like a good strategy on the surface. But, it could end up costing a homeowner even more money in the long run.

That is because the homeowner loses control over the condition of the home when it is on the market. They aren’t able to maintain the home and keep it up.

Most homes that have been foreclosed on are abandoned by the lenders. Sure, they “winterize” the homes. But, they don’t do anything to keep the homes in tip top showing condition.

This causes most bank owned homes to sell for less money. Here is something else that will cause you home to sell for less money. The buyers aren’t willing to pay as much.

Buyers know when a home for sale is bank owned. What do you think pops into them mind when they see that? “I can buy it for a steal”, they think to themselves.

This causes bank owned homes to sell for less. And if it sells for less money, then the bank will come looking for a larger deficiency payment.

This is why a short sale is usually better for you versus letting the bank foreclose and then sell the house.

El Dorado Hills CA – The Stop Foreclosure Institute recently received a question from Dan. Here was Dan’s Question.

"I recently purchased another home and tried to sell my former home. It isn’t selling and I can’t afford to make both payments. The home won’t rent for even 1/2 of the mortgage payment.

An agent told me the house is worth about $50K under the mortgage amount. Is it realistic for me to try the short sale? The only hardship created was when I decided to move to a larger home for family. Dan."

Here was our answer to Dan’s Question.

Dan, I think you can short sale your house. Do you have a legitimate hardship?

I know you said you needed a larger house. However, if you also moved for a job transfer, then most lenders would consider that a legitimate hardship.

A hardship is not black and white. Some lenders would consider your situation a hardship. More often than not they will approve the short sale.

Others would not and won’t work with you on a short sale. In addition, the lender may not work with you until you have missed a payment or two.

Whether or not you miss a payment is your decision. You should weigh your options and decide whether or not you can live with the resulting credit damage.

Many lenders will work with you on a short sale even before you have missed a payment. If you were working with us, then we would help you. But, we would have the expectation that it would be a 6-12 month process.

Make sure that you work with a competent short sale agent. Look for someone that is a short sale expert. Ask them how many short sales they have sold.

Ask them if they have worked with your lender in the past. Then you will be able to judge whether they are qualified to help you.
