Three days ago I present an offer on a condo to a well established Re/Max agent in Boca. He comes back the next day via email and writes " the sellers are countering at $.... and want ...."

I replied: "verbal counters are non binding, neither you nor I are parties to the transaction (and therefore cannot bind our principals), and you do not have a POA (Power of Attorney). You requested all offers to be in writing and I know you would have refused to present my offer if I just sent it to you in an informal email; so why would you expect me and my buyers to accept a non binding counter from you?

His response was that it was in his listing agreement with the seller that it was ok to do counters verbally (BS if you ask me)... I replied that my buyers were turned off and I would get back to him if anything changed in the future...

This is the perfect example of a dangerous agent. He is hurting himself, buyers, other agents and his sellers with this behavior, here is why:

- he turned off a qualified buyer who was willing to negotiate and buy this property. These buyers just got burned a few months earlier when the verbal negotiations on another property came to a full agreement on terms and price, but the seller received a higher offer just as the listing agent was going to forward the final contract for signature. Because the final negotiations were done via email and phone, they were non-binding...

- next time I deal with this agent, I will place in the initial contract that all counter offers will be made by either party in writing, and I will inform my clients that they have the right to call or write the sellers to complain about the listing agent's non compliance. I cannot do that because the code of ethics (funny...) does not allow me to bypass the mediocre listing agent and deal with the sellers directly. However, my clients can...

It is unfortunate we still have agents who do not understand the legal and financial implications of their irresponsible and careless actions...
