Tutas Towne Realty and Bryant Tutas just had another successful Kissimmee Florida Short Sale closing with Chase.

The property:

4 bedroom 2 bath single family pool home located in the Bellalago subdivision of Kissimmee Florida. This home has 2,254 sq ft of living area and was built in 2005. It was bought new in 2005 for $325,000 as an investment property.

Liens:

  • 1st Mortgage with Chase for $295,000

Hardship:

  • Loss of income and unable to find suitable tenants.

Issues:

  • The first buyer we had walked as soon as the short sale was approved. No reason. Just thought he could find a better deal. The property was placed back on the market and we had multiple offers in less than a week. We also had to convince Chase to pay over $15,000 in delinquent HOA fees. Chase agreed and paid these at closing. Chase also gave the Buyer $500 for pool cleanup.

The property sold for $155,000 or 48% of it's value 5 years ago. Chase accepted $106,500 on the 1st or .36 cents on the dollar. With full Waiver of Deficiency.

The Seller also received $20,000 from Chase at closing. This was part of the Chase Short Sale incentive program. Select Sellers are offered between $10,000 and $35,000 to do a Short Sale.

Do I Have To Miss Payments To Do A Short Sale?

Maybe. Maybe not. Some lenders/investors will require that you are 30 days late to receive short sale approval and some won't. As a Florida Short Sale Broker who has handled lots of successful Florida Short Sales I still haven't figured out what triggers the "You must be late" requirement.

Just recently I've experienced:
  • One seller was told they needed to be 30 days late. These Sellers have a legitimate hardship and are selling their primary residence due to major medical issues and job relocation. This is a Fannie Mae loan being serviced by Nationstar. We are currently asking for an exception. Illness and death are two hardships that enable the rules to be bent or broken when it comes to short sales. These two hardships normally take priority. So I'm optimistic that the 30 day late "rule" will be waived.
  • Another Seller just received approval from SunTrust on 1st and 2nd mortgages. These sellers have missed no payments and they do not have a hardship. Plus they received full Waiver of Deficiency and did not have to participate in the loss!! This too is a Fannie Mae loan. Needless to say they are very happy.
  • My third example is a very high income and high asset individual who is doing a short sale on an investment home. He has also has not missed any payments and just received approval last week form Wells Fargo. The seller is making a fairly large cash contribution but is receiving full Waiver of Deficiency.
When you look at these real life examples it shows that the one seller that should of been approved without missing payments is having difficulties. The other two, that are both Strategic Short Sales, didn't have to miss payments at all.

So......do you have to miss payments to do a short sale? I have no clue. And I don't think the lenders do either.

My suggestion? Make the payments if you can afford to do so. Don't drain your savings, use credit cards or harm your family to do so. Look towards the future. Does this help?

Chase is Paying My Seller $20,000 to Sell His Kissimmee Florida Short Sale!

Yes it's true. I didn't think it was when a potential Seller called me in December to see if I could place his Bellalago Short Sale on the market. He said that Chase contacted him and offered him $20,000 to short sale his Florida property. He had 3 days to get it listed and send them the listing agreement. They also told him he didn't have to provide them with any financial information. Just a listing agreement, contract, HUD 1 and a hardship letter.

My first thought was "Yeah sure". My second thought was "What's your email address so I can send over the listing agreement!!"

Once the property was listed I called Chase and they confirmed everything my seller had told me. I still had my doubts though.

Anyway, we found a Buyer and the documents requested were sent to Chase in March. Earlier this week we received the approval and sure enough....they are giving the Seller $20,000 at closing. Not only are they giving him this money but Chase also agreed to pay almost 3 years worth of pass due HOA fees totaling more than $15,000!!

This particular Bellalago short sale was bought as a Florida Investment home. It's currently vacant. The property was purchased for $325,000 in 2005 and just sold for $162,000. Chase accepted $115,000 on a balance of $300,000. Full Waiver of Deficiency. No contribution from the Seller.

Advice to delinquent borrowers: Be sure to open ALL correspondence you receive from your Lender. You may just receive "An offer too good to believe". Believe it.
