Help for the Buyer - Multiple Offers Without The Stomach Ache

I stay very busy working with buyers writing offers on short sales and bank owned properties in Destin, FL. I like to seek out the best deals for my clients and this often leads to multiple offer situations. This can be a very uncomfortable and stressfull situation for all agents and buyers involved. The tips below will help any buyer in this situation.

1. Do not make your offer based on the other offer. For all you know the other offer could be ridiculously low and have contingencies all over it or it could be above asking price. You will have no way of knowing the other offer unless the seller advises the listing agent to tell you. Speculation will get you nowhere.

2. Look at the comps and have your realtor provide you with a CMA "comparative market analysis". Make your decision based on the comps and base your offer on this analysis.

3. When you are told to submit your "Highest and Best Offer", submit your highest and best offer but understand that the bank or seller may ask for "Highest and Best" again. I have had this happen a few times.

4. Make your offer as clean as possible. Do not include too many contingencies because you may lose out to a lower offer.

5. I have seen many foreclosures and short sales sell for over the asking price. This happens all of the time. Sometimes banks and agents price homes under market to create a bidding war and many investors are aware of this.

6. The other agent is not lying about the other offer. This would be a major violation and we cannot assume this.

Keep a cool head and make a good offer when there are multiple offers on the table. Do not offer way too much and be careful with the low ball offers.

The reason why most short sales do not close is because the buyer walks. This transaction closed in less than 90 days and this is considered a "quick" short sale closing. WHY DO YOU NEED A REALTOR WHEN BUYING AND SELLING FORECLOSURES AND SHORT SALES?

Buying and selling short sales and bank owned properties can be a very rewarding process. Our current shift to a distressed market makes real estate agents even more valuable to buyers and sellers of distressed properties. These types of transactions are not typical and require a high level of expertise. One should hire a real estate agent that has the experience and training needed to successfully close one of these transactions. I am a certified distressed property expert (CDPE) www.cdpenow.com and I have also completed "Short Sale Superstars" training www.shortsalesuperstars.com. I personally endorse both of these systems and feel any Realtor would benefit from taking these courses. I have successfully closed both short sales and bank owned (REO) properties and I have to tell you they are not your standard real estate transactions. Below are some common issues when dealing with distressed properties.

Short Sales and Bank Owned Foreclosures (REO) - Why do you need a Real Estate Agent?

  • What is the correct way to complete a short sale package for a short sale listing?
  • What is the correct pricing strategy and price reduction strategy for short sale listings and REOs?
  • When buying short sales and foreclosures, listing prices can vary. The important factor is "value". A realtor can provide you with a CMA Report "Comparative Market Analysis". This report will show you the current value and help you make the correct offer. There are many overpriced short sales and foreclosures. Understanding the true value is critical and Realtors have access to superior CMA reporting through their local MLS. This will save you money and prevent you from overpaying.
  • What contract do I use? In Florida, we have the FAR, FARBAR, FAR WITH AS IS ADDENDUM, FAR BAR AS IS, and the SHORT SALE ADDENDUM. Different contracts should be used in different situations. For example, I feel the FAR/BAR AS IS contract works best when representing buyers of distressed properties because of the inspection period language.
  • Who is the best property inspector for REO's and Short Sales? Foreclosures and Short Sales are typically sold AS/IS. Do not let the name deceive you. An AS/IS sale is not a bad thing. It is critical that you have a good inspector to point out any issues with the property and have the correct inspection period language in your contract. Also, understand that utilities may have to be turned on for the inspection and the home may have been without power for months or years.
  • How do I negotiate with the Bank? There are many factors to consider when negotiating with the bank. How long has the property been on the market? Is it a local bank or larger Bank? Is it a short sale or a foreclosure? What is the condition of the property? The list goes on and on. A realtor can advise you on all of these situations.

A Realtor with distressed property experience has now become a necessity. I encourage all realtors to embrace this new market and I encourage all buyers and sellers of Real Estate to hire a Realtor with distressed property training and experience before entering into one of these complex transactions.

I was recently featured in the Walton Sun Newspaper as I was digging in the sand during a beach boot camp with my fellow workout partners. We meet four times a week for a beach workout that is killer. We start with heavy ropes walking to the beach in Grayton (about a mile) and those without the ropes have to carry medicine balls 15 pounds or more. Then we run -- balls ahead of the ropes, then ropes ahead of the balls. It isn't easy. It is a lot easier on the bike lane than it is in the sand. Once in the sand we have to do the heave and retrieve. More like I feel like heaving. It is hot and difficult. But being one of the oldest women in the class I try to keep up with my younger role models. So there I am heaving and retrieving a 16 pound medicine ball in the sand. Once we do this on an imaginary unmarked course, we next drop down for 30 push-ups in the sand. Have you ever tried to do push-ups in the sand? I am talking about the type of sand we have here at our beaches. Beautiful white powdery sand. It isn't easy, let me tell you. Okay, I got through them and then he made us roll over and give him 50 butterfly kicks. Not done yet, we had to dig a hole in the sand to the depth of our elbows. (I felt like my dog Haley at this point) Then we fill it back up so the sea turtles don't fall into them later this evening. One last move, don't forget the burpies. You may now be hurting yourself just thinking about burping. I said burpies. You have to drop to your hands do one push up and then jump back up and clap your hands above your head. Burp. They are killer.

Well, this is one way to stay fit as a Realtor. Now its on to sell, sell, sell.

I remember strolling into the living room, my eyes big and my smile bigger. I turned to my right and then my jaw dropped. There was one of the most beautiful paintings I had ever seen.
