Is a 55+ Community Discriminating Against Children?


I have lived in Venice Florida for over 20 years where we have many retired residents in the area. They are either full time or known as “Snow birds”. Some prefer to be in retirement communities without young adults or children. In that case is a 55+ community discriminating against children?

Most of the retired residents have children and grand-children; definitely they are not discriminating against children. So what is the point of having an age restriction?


Many like the idea of being part of a community “People of my age flock together; we are birds of a feather,” as the old proverb says. They enjoy the active and maintenance free lifestyle of living among retirees their age who share common interests like – bingo, golfing, shuffle board, tennis …


The children and grand-children may come for a vacation within a limited time, staying in the home but not moving in for permanent occupancy.


Is a 55+ Community Discriminating Against Children? Since the 1988 Amendments, the Fair Housing Act has exempted from its familial status provisions properties that satisfy the Act's 55 and older housing condition. At least 80 percent of its occupied units must have at least one occupant who is 55 or older, and that it publish and follow policies and procedures that demonstrate they provide housing for older persons. It must also verify the ages of occupants and register and pay fees to applicable governmental agencies.


The law gives the community some leeway by allowing up to 20% of the units not to be occupied by at least one person 55 or older. This is for the consideration if the qualified unit owner dies, leaving a younger spouse or children inherit the property.

The community must openly advertise its age restriction status. Buyers must sign a disclosure.


Any retired buyers thinking of buying in the 55+ community have to recognize that they may not be able to allow their children or grand-children to move in with them when facing financial hardship. Also when they are ready to sell the property, it will limit potential buyers to only age 55 or over.

My sister in law has a part time job which she can’t manage by herself, so she asked my husband (her brother) for help.

The trees are too tall and when ladders are too short, the only way to reach the top was by climbing the tree. The hero on the tree is Mr. Andy Huset - my Superman husband.
