Most Bank Foreclosures & HUD Requirements:

1. Valid Drivers License
2. Loan Approval Letter
3. Earnest Money Deposit
4. GA Licensed & HUD Certified Agent


    1. Valid Drivers License
      You don't have to be a GA resident to purchase properties in GA.
    2. Loan Approval Letter
      Unless you will be a cash buyer, you will need to talk to your bank or loan officer in obtaining a loan. With the current changes in lending requirements as well as 2008 changes in GA GAR forms and GA contract law, now more then ever is critical that you speak with reliable and knowledgeable loan officer.     3. Earnest Money Deposit (EMD)

Earnest Money Deposit is negotiable between the seller and the buyer but most of the times its 1% of the asking price. Higher EMD shows buyer's strength and can help you negotiate better deal.
    4. GA Licensed & HUD Certified Agent
      HUD requires all offers to be submitted by Licensed GA Real Estate Professional that have completed the HUD certifications in their state. Only HUD Certified Agents can open and show HUD properties to their clients.

Cobb County Homestead Exemption 2008

Applications available for homestead exemption

Homeowners have until Saturday, March 1, to apply for a homestead exemption for this tax year. Applications must be received or U.S. postmarked (a metered postmark is not accepted as proof of timely mailing) by March 1 to receive the benefit of the exemption for that year. Homeowners must apply for all exemptions for which they are eligible; thereafter, exemptions are automatically renewed each year unless there is a change in ownership or eligibility requirements are no longer met. It is not necessary to reapply if the home has been refinanced. The applicant's name must appear on the deed and the applicant must occupy the property in order to qualify. Homeowners may apply for homestead exemptions by mail. Most new property owners will receive an application by mail at the first of the year. Daniell Middle, Murdock Elementary Named 2007 Georgia Schools of Excellence.

Daniell Middle School and Murdock Elementary School have been named 2007 Georgia Schools of Excellence by the Georgia Department of Education. The two Cobb County schools are among only 23 schools statewide to receive the honor, and were selected based on overall excellence and gains in student achievement.

The Georgia Schools of Excellence program began in 1984 and has become a badge of honor for schools across the state. Cobb schools have received 39 Georgia School of Excellence designations since the program's inception.

Murdock Elementary meets this qualification in Congressional District 6, making the school eligible for a No Child Left Behind Blue Ribbon Schools Award nomination. Daniell Middle received District 11 distinction in the program's second category for showing the greatest continuous gains in student achievement in reading and mathematics over a three-year period. Schools chosen for either category must meet Adequate Yearly Progress for at least three consecutive years, meet or exceed state mean scores in Science and Social Studies and have 100 percent of the teaching staff meet Georgia's ‘highly qualified' standards.

How to dispute tax assessment for Cobb County GA

It is the desire of the Board of Tax Assessors to avoid appeals whenever possible. If there are serious concerns over the valuation of property, the owner should call or come by the office to discuss his/her property with a professional staff appraiser.

What if I don't agree with my assessment?

Call the Tax assessor Office. During this informal session you can learn how your assessment was made, what factors were considered, and what type of records are kept regarding your property. After this review, if I still think the assessment is incorrect, what can I do? The next step is to file an objection with the Assessor's Office. Your objection must be written. Forms are available in the Assessor's Office. When you receive your tax bill in October, it is too late to file an objection for that year. Paying your taxes under protest does not constitute an assessment objection unless you have first filed an appeal with the Board of Review. Note: You can pay 85% of your new bill to avoid the 5% late charge.

What evidence do I need to present?

State law puts the burden of proof on the property owner to show that the assessment is incorrect. Keep in mind that your evidence must be strong enough to prove that the assessor's value is incorrect. Only relevant testimony given at the hearing will be considered by the Board. STATING THAT PROPERTY TAXES ARE TOO HIGH IS NOT RELEVANT TESTIMONY. You should establish in your own mind what you think your property is worth. The best evidence for this would be recent sales prices for properties similar to yours. The closer in proximity and similarity, the better the evidence. Another type of evidence is oral testimony from a witness who has made a recent appraisal of your property. Note: Contact trusted real estate office for assistance with comps.

APPEAL PROCESS:

  1. PROPERTY OWNER IS SENT CHANGE OF ASSESSMENT NOTICE
  2. PROPERTY OWNER FILES WRITTEN APPEAL WITHIN 45 DAYS OF DATED NOTICE. APPEAL
  3. MUST INDICATE IF OWNER CHOOSES ARBITRATION IN LIEU OF BOE

  4. BTA ACKNOWLEDGES RECEIPT OF APPEAL AND FURNISHES VALUE REVIEW WORKSHEET
    TO BE COMPLETED BY THE OWNER (OPTIONAL) AND RETURNED WITHIN 15 DAYS
  5. STAFF APPRAISER EXAMINES PROPERTY VALUE AND ANY OWNER CONCERNS MENTIONED IN LETTER OF APPEAL
  6. BTA REVIEWS APPEAL AND RENDERS DECISION
  7. BTA NOTIFIES PROPERTY OWNER OF DECISION WITHIN 180 DAYS
  8. PROPERTY OWNER MAY APPEAL TO BOARD OF EQUALIZATION (BOE) WITHIN 21 DAYS
  9. AFTER NOTIFICATION THAT THE BTA CHANGED VALUE
  10. IF BTA DOES NOT CHANGE VALUE, APPEAL IS AUTOMATICALLY FORWARDED TO BOE OR TO ARBITRATION IF REQUESTED BY OWNER IN LETTER OF APPEAL

What kind of homes will sell better in Marietta GA in 10 years?

Q.) Kris,

I am curious about something.

1. We are not planning to live in the Atlanta area until we retire. We plan on moving back to S. GA in about 10-15 years and build a home there. Therefore, the house we buy up here is going to sold. What kind of homes do you think will sell better. A house with less appeal but extra sq ft or a traditional home with less sq ft?
2. Do you have information on foreclosure or pre-forclosure homes?

After talking with Brett, I think we like the more traditional house. We prefer the Shanty home instead of the Cobb Manor house. I like the basement but he prefers the Shanty home.

A.) Hello J,

East Cobb has been experiencing very healthy gains in the past 30 years and it will continue to be a desirable location because of its East Cobb Schools.

However it is not the type of home that makes the difference but the area and location that it is in. If you purchase a home for investment make sure there is nothing that will exclude certain customers when you are ready to sell.
For example building a swimming pool or turning the basement into a bar. Not everyone wants to deal with the maintenance of the pool and not everyone wants to entertain friends all night long. See also "Does it pay to remodel"?


Keep it simple and allow the next customer to customize the home for their own needs. Usually buying a home with less appeal or in need of TLC provides opportunity for the new owner to fix those shortcomings and there for improve the value of the home. If you are planning to live in the home for over 5 years you should concentrate in finding a home that you personally like and matches YOUR lifestyle. It has to be close to the things that are important to you, (your work, school, shopping) Making a decision that is based on what will the next home buyer wants 15 years from now will be very speculative as things change and what's popular now might be obsolete then.

It is clear to me that you are looking for something special! I would suggest that we go and see both homes that you like. Also it will give me a chance to meet you and find out more about your plans. Let me know if Tuesday or Wednesday at 1pm works for you.
