Why are Builders LICENSED AGENTS Held to a Different Standard than ALL other LICENSED AGENTS in Maryland?

In Maryland last year Builders were required to have ALL of their sales agents to get their real estate licenses. There were many reasons for this; the main ones were to supposedly benefit the buyers who decide to purchase new construction from builders. However, from what I have seen in the past year, it really doesn't matter that they have their licenses now as many of them are still doing "business as usual" and violating AGENCY LAW!

When I meet a prospective purchaser at the FIRST FACE TO FACE appointment I pull out the Understanding Whom Real Estate Agents Represent (Agency Disclosure) Form and go over it with them as this is REQUIRED BY LAW! During this disclosure if I am showing one of my own listings I am required to tell them that I work for the seller. I also ask them if they are working with a real estate agent either through a written or a verbal agreement and if they are I certainly DO NOT EVER try to BREAK UP that relationship. When is the last time that you have heard a builder's licensed sales agent tell someone that they represent the builder? Have you ever seen them use an agency form? The only form I have seen is a registration form that they require to be filled out as soon as the prospective purchaser walks in the door so that they can cut their agent out of the deal if their agent is not there with them!

Bottom line, BUILDERS SALES REPRESENTATIVES or their now LICENSED REAL ESTATE AGENTS continue to violate AGENCY LAW and tell prospective purchasers that they can give them a better deal if they don't work with their real estate agent (EVEN IF THE BUYER TOLD THEM THAT THEY WERE WORKING WITH ONE IN THE FIRST PLACE)! That is no different than me telling someone who is interested in one of my properties if you purchase it without your agent, I can get you a better deal! That would certainly put me in an arbitration hearing and possibly in front of the Maryland Real Estate Commission where I'm sure I would get a fine at a minimum if not lose my license entirely.

If you are considering buying a new home in Maryland make sure you understand that the BUILDERS AGENTS work for THE BUILDER, NOT YOU! They do not represent your interests and will not negotiate for you on your behalf (even though many of them act like they are doing that). If you are considering purchasing a new home, I would highly recommend locating a competent real estate agent in your area who can help you negotiate and look out for your interests in the transaction!

Just Because the SIGN SAYS 1.75% Doesn't Mean that is What YOU WILL PAY!

I hope you don't mind, but I have to get this off my chest. A while ago I wrote a post that was very controversial with the DISCOUNT BROKER community that I eventually deleted, but after this past Sunday wish that I didn't. I was sitting at my open house this past Sunday when a prospective purchaser came in and mentioned to me that he was very interested in the home, but told me that he had to sell his that was already on the market with a 1.75% DISCOUNT BROKER. After talking for a while he told me that he was very upset with his agent for lack of services, marketing, etc, and wanted to know if I would list his home for him, but wanted to know what I would charge him. To his surprise I was only going to charge him a slightly higher commission percentage than his so called 1.75% agent/broker had initially promised (on the sign on the front of his office)!

YEAH RIGHT, SURE IT IS!

But how could this be? The reason is simple, that 1.75% sign on the front of the office that he originally walked into isn't what he actually signed the listing agreement for! That is right, he was suckered into going into the 1.75% office because of FALSE ADVERTISING and UNDER FALSE PRETENSES and eventually empty promises. After finding out that he was going to have to pay 4.25% when all was said and done, he couldn't believe it, but that 1.75% got him in the door!

I personally think that doing business like that is completely unethical and would never try to "MISLEAD" a consumer into thinking that the charge of the real estate transaction was only going to cost them "1.75%" yet this is in the DISCOUNT COMPANIES STANDARD OPERATING PROCEDURE!

HOW and WHY does the Maryland Real Estate Commission (and for that matter the Federal Authorities) ALLOW THIS TYPE OF FALSE ADVERTISING TO CONTINUE?

SHOULD I START TELLING PEOPLE THAT "MY FEE" IS 2.5% or 3.0%? AREN'T ALL COMMISSIONS NEGOTIABLE (I THOUGHT THEY WERE THE LAST TIME I CHECKED? IF SO, THEN HOW ARE THESE DISCOUNT BROKERS ALLOWED TO ADVERTISE "THEIR FEE" ON THEIR SIGNS?

****JUST FOR THE RECORD, FOR THOSE OF YOU THAT WORK FOR A 1.75% DISCOUNT BROKER, I DID NOT MENTION ANY SPECIFIC BROKER OR OFFICE IN THIS POST, I SIMPLY SAID "DISCOUNT BROKER" AND THIS IS NOT DIRECTED AT ANY SPECIFIC BROKER OR OFFICE JUST DISCOUNT BROKERS IN GENERAL AS THE PUBLIC HAS A RIGHT TO KNOW ABOUT THE FALSE ADVERTISING AND THIS WAS POSTED IN THE PUBLIC'S BEST INTEREST NOT YOURS (IT IS THE TRUTH, AND WE ALL KNOW SOMETIMES THE TRUTH HURTS)!****

  • Stack woodpiles neatly

  • Replace old storm doors
  • Check for flat fitting roof shingles
  • Repair broken windows and shutters, replace torn screens; make sure frames and seams have caulking
