What You Need To Know About Contengencies

Let me start by telling you what a contingency is. It is a formal clause in a real estate contract, that specifies particular conditions that must be met by either the seller or the buyer in order to proceed to the next step in the contract. Contingencie are found in every contract to protect the interests of both sellers and buyers. If either side fails to meet any of the requirements, it can result in breach of contract.

There are three different categories that make up a contingency. Protection for the buyer, protection for the seller and reciprocal protection of both parties. Most contracts normally contain two contingencies, the mortgage contingency and home inspection contingency.

A mortgage contingency stipulates that the buyers will make every effort to obtain a mortgage for the particular amount the seller is asking for. If the buyer obtains a mortgage then the contingency is removed. However, if the buyer cannot obtain a mortgage for whatever reason, then the buyer may withdraw from the contract without penalties. So the mortgage contingency protects the buyers interest if financing is not available they are not held to the contract they had signed.

A home inspection contingency also protects the buyers. If the house is found unsuitable due to issues such as, significant termite damage, unsafe electric wiring, or material defects, it allows the buyer to be able to withdraw from the contract without penalty and the return of all deposits. If issues that are found are found fixable, it gives the buyer the ability and right to negotiate repairs with the seller.However if the seller refuses to repair any of the repairs for the buyer, the contract becomes invalid, stopping the seller from forcing the contract on the buyer.

Contingencies can vary depending on the circumstances and what they require. Buyers can include anything from asking a seller to remove something to asking for a new water heater to be installed. On the other hand, sellers can have their own requests as well to the buyer, like asking for a certain amount of time to remove things from the home or property or giving them enough time to vacate the premises.

There are two important things to keep in mind when contingencies are involved....

One, having several contingencies from either side by the buyer or the seller, can weaken the contract and make it even more complicated than it has to be. To many from the seller can push the buyer away from the deal and to many from the buyer can push the seller from accepting the deal. Second, always work with an experienced agent to make sure that all your interests are taken care of , so you know that all your rights are protected, regardless if your the seller or the buyer.

I knew a family who found a gorgeous house in an area that they fell in love with, of course, the neighborhood was quiet during the day every time they went over there, didn't seem to be alot of people hanging around, so they assumed the neighborhood was wonderful. Only to find that night they were moving in, to find people out being loud and partying in the streets and drive ways. They could hear car alarms going off and everything. Now they were stuck in a purchase contract in a horrible neighborhood.

Whether you are going to buy or rent in any area you need to make sure the neighborhood is exactly what you expect it to be. There are quite a few things you can do to check into the neighborhood your considering to live in. Below is a list of things that will help you to determine if your potential neighborhood is right for you.

  • You can contact your local police department ask them how safe the area is.
  • Check the schools in the area, see how they rate and what their statistics are.
  • Have your reatlor run some comps to see the selling history in the area.
  • Are there any new businesses coming into the area? Usually, this is a sign of a vital neighborhood.
  • How are the yards in the area kept and is there any home improvements being made? This will show that people in the neighborhood care about their property.
  • Are places like grocery stores, pharmacies, and banks nearby?
  • Drive through the neighborhood at all different times of the day on different days to get a better feel of how things are at all times.

Anything else you can think of to check your potential neighborhood, you should do it. Do your homework, before committing to anything, save yourself from getting any headaches.

Bradford Realty Group Wins Trophy!

Trunk N Treat brought THOUSANDS of children and parents to our church at Community Bible Church on Sunday, October 26th. An hour after the event was suppose to be over, the last of the children made their way through the line.

We had 4 rows of trunks filled with treats. We had a soccer field of games and food. We had one heck of a great time, and the kids did too!

This year Bradford Realty Group decided we were going to go for the Fall Festive Trophy. We wanted something simple, but yet cute. We wanted festive, but yet not over the top. We must have done it just right! We WON!!

While the event was a lot of fun and really all about the kids, we could not let the opportunity go by to let others know about what it is that we do. It is a great time to hand out business cards, flyers, brochures, etc. Trunk N Treat is another example of how you can give to the community, but also share your business with others.

Last year, I received a listing from Trunk N Treat. I also received calls from people who had general questions. It really was a success on so many levels.

The more you are out and involved in the community, the more you will find success within your business. However, do not do it for the wrong reasons! The COMMUNITY MUST ALWAYS COME FIRST!!! If you give from the heart, you will be rewarded abundantly.

This year was a very creative year for the Trunker's. Some really put time and effort into their trunks. The smile on the children's faces, the rumbling of parent's laughter was all more than we could have expected. Trunk N Treat is an event, that we will NEVER miss!

Now to start preparing for next year! This year we planned for 3000, next year I think we better start at 4000!

A few weeks back, I made the announcement that Bradford Realty Group was expanding! I announced that our new Buyer's Agent, Alison Hunter was coming aboard.
