Beware Short Sale Shock!!!

Recently I was involved in what I thought was a Short Sale. I had the buyer the seller/home was listed with another agent from another company. The listing agent told me it was short sale and we had to close the transaction at the end of the month. My buyers have cash so no loan to worry about.

The sellers had already moved out of town and had left the home a mess which my buyers didn't care about. We go under contract at the asking price which is about $50,000 less than the orginal mortgage. The first problem arises when the title committment arrives with an unpaid judgement against the sellers for an unpaid medical bill in an amount less than $2,000. Of course the sellers do not have the money to pay said judgement that's the reason they are getting foreclosed on, they have no money. The listing agent tells me he will talk to the lender, the collection agency and the seller to see if there is any way we can get the judgement paid, lowered or any other senario.

Last week I receive 2 phone calls in quick succession, one from the listing agent, one from the title company, the messages were to the affect that the house had sold 10 days previous on the court house steps for considerably less than my contract price. WHAT ??? I am asking myself, how the _____ does that happen. Who was the listing agent talking to ?when supposedly negotiating a short sale, I am still waiting for him to call me to explain that.

The good news for my buyers and me is that a few days later I was able to put the deal back together with the new owner.

The moral of the story for me is to check the foreclosure list to see when a house is going to sale instead of relying on another agent telling me when it is going to sale. He said the end of the month, it turned out to be the 10th.

Best Week in Over A Year

Last week June 8th thru June 15th was the best week our company has had in over a year. In that 7 day period we put 11 properties under contract and listed another 18. Bear in mind that this is a town where in the last year no more than 50 homes have closed in any one month. For example for the entire City and County of Montrose Colorado just 37 homes sold.

The market has definitely been picking up, is it just the time of the year? after all it is June. There has definitely been a change in attitude with buyers in the last few months to a more positive out look. I do not hear "I'll wait to buy because prices are going to continue to fall"
