Could your closing be delayed 6-7 days due to new Respa Regulation effective 7/30/09

Mortgage Disclosure Improvement Act of 2008 has provisions that are going into effect July 30, 2009.

Do you have a pending sale or listing that was done before this time? Have your attornies (if they are not aware of this new provision) re-check all third party figures with a preliminary HUD a good 1-2 weeks before closing to get to your mortgage rep or broker so the loan package can arrive on time or this could delay your closing date 7 days!

The 3/7/3 Rule requires a seven business day waiting period once the initial disclosure is provided before closing a home loan (business days are everyday except Sundays and Holidays). This means that before a borrower can close on a transaction the borrower must receive the initial Good Faith Estimate and initial Truth in Lending statement disclosing the final Annual Percentage Rate (APR) seven days prior to closing.

If the final annual percentage rate APR is off by more than .125% from the initial Good Faith Estimate disclosure then the lender must re-disclose and wait yet another 3 days before closing on the transaction.

We the undersigned understand that the intentions of the Home Valuation Code of Conduct ("HVCC") were to help curb the potential for fraud with respect to the valuation of residential properties. We must however bring to your attention the reality of the situation that HVCC has already caused.

  1. Since "Appraisal Management Companies (AMC’s)" are taking up to 40% of the total appraisal fee, and are not being regulated to ensure that their appraisers are licensed and competent, we are seeing unlicensed and inexperienced individuals performing property inspections with grave data entry errors. These inferior appraisals are then being “signed-off” by other parties that NEVER INSPECTED THE PROPERTY and are creating unnecessary financial hardship for buyers and sellers.
  2. With mortgage loans being denied due to inaccurate appraisals, borrowers are being forced to apply with other lenders who in turn have to charge the consumer ANOTHER APPRAISAL FEE to proceed with the transaction. This vicious cycle can go on endlessly costing well intended clients a great deal of money and time.
  3. Under HVCC, no one involved the transaction is allowed to communicate these major issues directly to their appraisers so countless real estate transactions that would have otherwise closed are now failing, resulting in continued property devaluation and offering NO stimulus to our economy with the exception of the unregulated AMC’s who are making unjustified profits at the expense of qualified appraisers and homeowners.
  4. Licensed appraisers have legal and ethical standards in place already. The emphasis should be on making appraisers abide by these, rather than frustrating the ordering and communication process. This well intended legislation is severely misguided.

Although HVCC has good intentions, its flaws are severely hurting our housing industry, the consumer and our economy. We are requesting that HVCC be discontinued or thought through thoroughly and retooled in order to stop the devastation it has caused and will continue to cause on our housing industry and our economy.

Economic Stimulus Plan buy-down mortgage rates to 4.5% or less for a 30-year fixed rate Ocean County NJ

As I am sure you are aware, the Senate will be voting on the Economic Stimulus Plan very shortly. Our Government Affairs staff in Washington D.C. has just informed us that a Senate vote on the Economic Stimulus Plan could occur as early as tomorrow, February 6. We have also been advised that special Amendment #353 to the Plan, a provision for the Federal Government to buy-down mortgage rates to 4.5% or less for a 30-year fixed rate loan for the purchase of a primary residence, will be voted on as early as TODAY. It is therefore incumbent on everyone in the nation to voice their support of Amendment #353. Without question, a 4.5% or lower, 30-year fixed rate mortgage would help stimulate housing sales and would also open the door to hundreds of thousands of new potential buyers by greatly improving housing affordability.

The time to act is now. Click here to find the contact information for your U.S. Senators listed by state with their Washington D.C. office contact information. I urge you to pick up the phone and call them right now and voice your support of Amendment #353. When you call, you should reference that you are calling in strong support of Senator Ensign's Amendment #353 to the Economic Stimulus Plan, provide your name and company information (including location), the number of sales associates and offices you have, and the number of real estate transactions your company participated in last year. You should also state why you think a mortgage buy-down to 4.5% or less will help stimulate housing sales in your community and the impact that will have on the local economy. If you get voicemail, that's fine — just leave a message with all that information included.

It is not often that we get to influence legislation that will have such a direct and profound impact on our business. Again, I urge you to call right now and voice your support of the mortgage buy-down Amendment #353.
