A Real Estate Attorney is used in a Real Estate Transaction to conduct the settlement and to protect the buyer's interest in the transaction. The first thing an attorney does is order a title search on the property and the seller. The attorney is looking for a free and clear title to the property so that it can be transferred to the buyer with no problems. A title search should go back 60 years and should search all available public records regarding the property and all owners.
The attorney will also order a survey to be done on the property. The survey will show the boundaries of the property and the structures on the property. The purpose of the survey is to reveal encroachments, boundary line problems, set back problems, etc.
The most important job of the Real Estate Attorney is being an advocate for the buyer and represents the buyer in the transaction. The attorney should only represent the buyer so that their is no conflict of interest. The attorney should also explain the terms and condition of the loan to the buyer so that they understand and confirm it is the same as they thought they were getting.
Some states require attorneys to be used and some states do not. Delaware requires a Delaware Licensed attorney to be used for all Delaware Real Estate Transactions. Maryland doesn't require attorneys, a notary will be able to conduct the closing. The difference is the notary cannot perform all of the functions listed above.
