Salem, Oregon... C.I.T.Y. - Chickens In The Yard Hopes for Urban Hens in Salem

The Urban Chicken Movement has come to Salem, Oregon! The media has covered it since February when the local group C.I.T.Y. - Chickens In The Yard presented six months of research and documentation on the benefits of a few hens in the backyard of residents who choose to have them to the Mayor and city council.

C.I.T.Y. continues to gain strength and number through their website: www.salemchickens.com, and their Salem Chickens Yahoo group and C.I.T.Y. FaceBook The group has been doing public outreach at the Salem Public Library, and other venues with an educational display that outlines the benefits and myths of backyard hens.

Most people can see the benefits a few hens can provide and are surprised that Salem isn't part of the Urban Chicken Movement that started in the Northwest and has spread like wildfire across the nation. New York City allows urban chickens! Portland has allowed them since 1964! Eugene, Corvallis, and Lake Oswego also allow residents to have backyard hens. Why not Salem???

Finally, on Monday, May 11th, the issue will be put on the agenda. C.I.T.Y. and its supporters hope that the issue will move forward quickly as it has done in other places who have used the group's research.

Backyard hens eat weeds, grass clippings, bugs and slugs and turn them into fresh eggs and excellent fertilizer for gardening.

(We keep a little black book of our interactions with other agents, how they were to work with, their professionalism, etc.)

We can also educate you about the things you need to watch out for when you list your home.

First off, if you have found a home you liked and contacted the listing agent, they will most likely offer to list your current home for you, as well as help you buy the new home. We recommend against that.

Buyers aren't the only ones who need to be educated and aware before entering the world of real estate. Buyers aren't the only ones affected by entering into what Oregon calls "Disclosed Limited Agency." If you as a seller share the same agent you face the same problem of not being represented to the fullest.

You should have your own separate agent to buy a home, and you should have your own separate agent to list your home. It is best to have someone specialized representing you in each area.

It may be the encouraged tradition to have the same agent for both transactions, but having an Exclusive Buyers Agent for your home purchase is the best way to protect your interests 100% exclusively. We want that for you when you buy a home in Portland, Salem, Silverton, Corvallis, Albany, Dallas or any of the other Oregon cities we serve in the Willamette Valley.

The best way to protect your interests when selling your home is DO NOT ENTER a Disclosed Limited Agency Agreement which allows your agent to represent you and the buyer.

It's called LIMITED because it LIMITS your representation.

This is not in your best interests as a seller.

There are some real estate companies that do not practice limited or dual agency. This means that if you are listing your home with them, they will require the buyer to be represented outside of their company. This is a good thing and gives each team their own coach and own private locker room so they can play to their full advantage, uncompromised. We respect companies that try to eliminate conflict-of-interest and would love to refer you to a company like this if you need to sell your home.

3. Do you EVER participate as a "dual agent" where you personally work with a seller and buyer at the SAME time, in the SAME property transaction?

Our answer is NO...NEVER.

Our agents ONLY represent real estate buyers. We have 100% loyalty to buyers at all times.

If the agent answers YES...

If you have an agent who is working with you AND the seller at the same time, with the same transaction, both the buyer's and seller's negotiating positions are compromised. The agent is legally bound to do NOTHING that will increase the advantage of one over the other. The agent is the only winner by getting a double commission. Both the buyer and seller lack full 100% exclusive representation.

Several states have legislated ground rules for this so-called dual agency and many of the nation's biggest real estate firms now regularly practice it. But consumer advocates say it cheats both buyers and sellers, denying them an agent's allegiance and undivided attention at a time when they're making a major financial decision.

4. Does your company EVER participate in "dual agency" where one agent within the company works with the seller and another agent within the company works with the buyer, at the SAME time, in the SAME property transaction?

If the agent answers YES...

Even though it might seem better than a "dual agent" scenario, it still leaves a buyer WITHOUT 100% exclusive representation. It would be like having one law firm representing both sides in a legal case. Even if different lawyers are used for each side, the potential for damage to both parties exists and a law firm will NEVER represent two sides of a case within the firm.

"Dual agency (when an agency represents both home buyers and sellers) creates relationships with clients and customers that aren't clear-cut. In a dual agency relationship, (a realtor's) fiduciary duties to (their) client's interests are much more limited. (They) can no longer be an advocate for either party because each client has opposite goals."

5. Do you pledge 100% loyalty for each buyer in a written and signed Buyer Representation Agreement?

Our answer is YES...ALWAYS.

We sign a an Exclusive Buyer's Agreement with you that carefully details how we will protect your interests, what you can expect from us, and it binds us to you in our pledge of 100% commitment and loyalty in representing you and your real estate needs.

If the agent answers NO...

It is through this written and signed agreement that you receive a pledge and promise of 100% loyalty and 100% representation. If an agent is going to offer you anything, they should put it in writing. If they won't offer you 100% loyalty and 100% representation is this good enough for you?

"Sellers' agents and dual agents do not and cannot by law give a buyer the same degree of loyalty as an agent who acts on behalf of a buyer. ... A buyer who relies on the seller's agent or on dual agency does not receive the same degree of legal protection as that afforded by an agent acting solely on behalf of the buyer."

Salem, Oregon...Who is the REAL WINNER in Limited (Dual) Agency?

dual agency limits youUsing the same agent the seller is using is like two competing sports teams using the same coach, in the same locker room, before the biggest game of their careers. How well would that work?

Both teams have conflicting desires - they both want the highest score at the end. In real estate, the buyer and seller also have similar conflicting goals.

Buyers want to pay the lowest price and have the best terms for their interests, and sellers want to receive the highest price and have the best terms for their interests.

When each side wants different things, how can one agent give each party 100% loyalty?

The answer is: They can't.

Because of this real estate agents in Oregon are required to have the buyer and seller sign a "Disclosed Limited Agency Agreement." This agreement states that each side is being represented by the same agent. What it really means is that you are not getting 100% representation - you are sharing your representation and the agent is sharing their loyalty to you.

That's why it's called "LIMITED" when you use the same agent as a seller.

Why would anyone ever sign a "Disclosed Limited Agency Agreement?"

Only because they don't fully understand what it means to have limited agency and representation.

So, we've explained in pretty simple terms why Disclosed Limited Agency WILL NOT give you 100% representation when you buy a home in Portland, Salem, Silverton, Albany, Dallas, Corvallis or anywhere else in the Willamette Valley.

But what about a regular Buyer Agent, don't they represent you?

Well, yes they do, BUT if they work for a company that also lists property, can you be sure they are not steering you towards their company listings? While you are offered more protection than using the listing agent, will they have the same enthusiasm in showing you every property you are interested in?

I've heard this complaint from many consumers: "My agent will only show me homes listed by their own company. When I want to see something from another company, they discourage me." This is a big problem for consumers and has been noted on the national level:
