Foreclosure Insights-Huntington Beach Homes for Sale

In California we have non judicial foreclosures for homes that are foreclosed on. Compare that to Hawaii that has both Non Judicial and Judicial and you will quickly realize how fortunate we are. In plain english that means that because we have a non judicial foreclosure process, it does not require the lender to suit you for non payment and require you both to go to court. Instead, the lender files suit against you through the use of a Notice of Default which is sent to the homeowner who is obligated to the debt (the person who took out the loan and signed the loan papers with the lender). By the way, non judicial foreclosure is much more affordable than a costly judicial foreclosure.

When you took out a loan to purchase your home or to refinance it, in the Note (not to be confused with the Deed of Trust) has language that states your terms of agreement, including your terms such as interest rate, monthly payment, due dates, late payment penalty's, and if the loan is delinquent by 30 days or more your foreclosure process i.e. notice of default etc. It even has the trustee that will serve your notice of default also known as N.O.D.

Once you are 30 days late, the lender has the right to file a notice of default, this is a 90 day period where you can redeem the loan by bringing it current and get the home out of foreclosure. If the loan continues to be delinquent, then after the 90 day period is over, the lender can file a Notice of Trustee Sale, which is typically about 25 days long and on the 25th day the home is sold at the Trustee's Auction Sale to the highest bidder. Typically the opening bid is whatever the outstanding loan balance is as of that date. In order to purchase at the court house steps Trustee Auction Sale you have to pay the entire winning bid amount as is, all inspections need to have been completed and you need to be satisfied with the home as is. You are normally competing with investors in this arena.

Once the home is sold at auction or if it goes back to the bank a Trustees deed upon sale is recorded. If the bank takes back the home, it then prepares the home to go back on the market as a Bank Owned Property also known as an REO which stands for Real Estate Owned. The Bank calls their REO Broker who prepares the property for market including evicting existing inhabitants.

It is richly diverse in the number of out door activities you can pursue year around. Lately I keep getting asked what do I do. So I decided to blog about it. In short (no pun intended- in case you didn't know I am barely 5 Feet 1 inch) I am a Broker and Equity Maximization Specialist. As a wife, mother, neighbor, friend and business owner I know what is important to homeowners in our community. My 3 children have gone to both private and public schools here and have participated in swimming, Robinwood Little League baseball,Scats Gymnastics,Gymboree,Ballet, Jazz, Waterpolo, Improv Group & Golf. I personally Golf (the divet and duffer queen admitedly, but hey I try), paddleboard, kayak and love to horseback ride. I am part of a wonderful group of Women who make up the GNO group which stands for Girls Night Out-where mom's leave the kids behind with either hubby, a babysitter or if they are old enough they stay at home. Every couple months we do something fun like play Bunko, Go To Bella Terra to the Movies, to Dinner or Endless Food and Fun. It's a time for us to just let our hair down, sometimes bring fun appetisers or like our friend Trish likes to say some "shots of fun" which means she is bringing her jellow shooters. Before you start your hate mail about drinking and driving, NEWS FLASH-we got that covered. Although many of the girls drive to my house, either I am the designated drive and I pick and drop off everyone off or my Saintly husband Scott or one of the other Saintly hubbies, usually take everybody home no matter how early in the morning it might be. And yes sometimes it's 2 or 3am! The next day the come back with their hubby's to get their car. Since everyone lives nearby it's no big deal :) Last Friday 4 of us met at my home for some very fine Red " Adelaida Cellars Cabernet Sauvignon (what a treat) "Vino" then went to see 50/50 a comedy flick at Bella Terra.

A little known fact about Huntington Beach is the high ratio of homes that are owned free and clear. 40%-60% of the homes are free of a home loan or equity line of credit. Considering how much we hear on the news about foreclosure rates and the number of homes having notice of defaults filed, it's astonishing to see how some neighborhoods have 6 out of 10 homes free of any mortgage debt. I find that absolutely thrilling, because it shows a very stable, strong and secure economic base and foundation for our city. I have actually done the research for each zip code and for the entire Huntington Harbour, and the tracts above where I market actively. For example the Prestige Tract is at 53.59% which is 313 of 584 homes!

Another intersting fact is we have 4 zipcodes

92646,92647,92648,92649 they average about 14,450 homes per zip with the smallest zipcode has 11,384 homes and 48% of the homes are free and clear and the largest is 19,668 homes with 54% of the homes are free and clear. Pretty exciting wouldn't you agree? Your are probably thinking I am a little geeky getting excited over these numbers, but trust me, when I represent you to sell a home, you won't think I am geeky, you'll be glad that "those numbers" which are YOUR Dollars, I am watching them like a hawk! Seriously, you don't have to invest your time with that because I make it my business to know my business inside and out and use all of the numbers to negotiate in your favor.
