Risk-Free Short Sale?

Short Sale Home For Sale

Friday 7/15/11, a law signed by Gov. Jerry Brown came into effect prohibiting a deficiency judgment following a short sale on a one to four unit property. This Senate Bill 458 is a step in the right direction for clearing the backlog of underwater mortgages and helping distressed homeowners who have been hesitant about short selling their homes.

Until now, the exception to the deficiency judgment applied only to purchase-money loans, leaving distressed sellers open to possible suit for amounts owed on second mortgages and other junior liens.

How much will it impact the real estate industry? It may get some homeowners off the fense and into a position where they can consider a short sale, instead of waiting for an inevitable foreclosure. Foreclosures are more dramatic at every level and this chart dramatizes the pros & cons of short-sales vs foreclosures.

Does it mean smooth sailing for distressed homeowners? Not entirely. No one enters a short sale lightly. Homeowners have been already in a precarious situation for quite a few months trying all possible avenues (modification loans, bank negotiations...) before concluding that a short sale is the only way to avoid foreclosure. By taking a few major hurdles out of this way for some, it will benefit everyone in the long run, helping to promote short sales and limiting the effect of foreclosures. This law takes effect immediately.

Here in Topanga, the percentage of short sales and foreclosures is close to 40% with a hefty amount of distressed properties located in “Top of Topanga”, Viewridge or Summit Pointe Estates and, increasingly it seems, in the rest of Topanga as well.

Anyone for a Weekend Staycation in Topanga?

That looks like the best option this weekend. I am referring, of course, to the closure of a heavily used portion of the 405 freeway from Friday 7pm until Monday 6am due to the partial destruction of the Mulholland Bridge for the widening of the road. Everybody is bracing themselves for the “ordeal” of the major road closure and the newspapers abound with alternative options, one of which is (unfortunately) Topanga Canyon Boulevard.

Granted, Los Angeles often feels like a beehive where the notion of commuting hours is ever expanding; it is a city that never sleeps. It would seem that such an occurrence would lead people to slow their pace of life and re-discover their neighborhood; maybe enjoy local activities whether going for a local hike, shopping at a local store or even having a “road closure party”?

In Topanga, it will be another opportunity NOT to go anywhere outside of the canyon. That can be a blessing -- as the best weekends are often those when we don’t have to leave the canyon, or even get into a car. We are blessed with formidable trails in the Santa Monica mountains to fit every level. And this weekend, the renowned Theatricum Botanicum will showcase the work of Shakespeare and Moliere with Tartuffe, Richard III and the Merry Wives of Windsor; all this in a bucolic outdoor theater with professional and talented actors.

However, funny enough, since the L.A. Times mentioned Topanga Canyon Blvd as an alternative road between the valley and the Westside, we can actually expect to see a major increase in traffic. Hopefully some drivers who decided to brave the detours will take the time to slow down, “smell the roses” and enjoy the uniqueness of our community.

How about having Brunch at our famous Inn of the Seventh Ray? or maybe go hiking in Topanga State Park? You might find out that Topanga Canyon is not just an alternative road but a neat place to live in. So check also our local real estate, just in case....

Topanga Blues Festival

The Topanga Blues Festival is coming back to town the first Sunday in May. If listening to top blues bands in a bucolic setting sounds appealing, this festival is for you. Set in Will Geer’s legendary Theatricum Botanicum (better known for summer Shakespeare and other plays), the outdoor stage opened its doors to talented blues musicians and their fans some 27 years ago and the event has grown in popularity ever since.

Promoted by the Southern California Blues Society, this year’s event will include talented artists such as the multiple award-winning Chick Willis in a rare Southern California appearance, Lynwood Slim renowned for his talent on the harmonica, Gregg Wright who will take you down memory lane with his deep voice, and Sean Lane, famous for his front porch style old-school blues .

Tickets can be purchased directly on the SCBS website. They are $28.50 for members of the SCBS and $38.50 for the general public. Please note that since Will Geer Theatricum Botanicum can only greet about 300 people, the event has quickly sold out over the last few years. Be sure to pack your picnic basket so you can enjoy a relaxing meal under the shade of the ancient oak trees on the Theatricum’s park-like grounds.
