It is crucial to stress the importance and be aware of what is happening to distressed homeowners. They have enough on their plate to worry about! My very first transaction was a successful short sale. And I am sure other Realtors® have experienced it!
Bare with me while I mention my client's experience, the ill family member, the single parent, the abused, the cut hours, the troubled teenagers, the long divorce, wrongly accused at work for an accidental suicide, the drug addict parent is useless, the over time isn't enough for the family of 4, the tenants "stole" water from the neighbor because the owner's water was turned off, the stress. The tenants had to be reminded to leave due to the showing appointments. Eventually they left.
To you currupt and crooked agents and short sale negotiators, please leave the professionalism and moral practice of selling homes to us, The Realtors® that not only take pride in what they do for a living but work hard for the homeowners that can't do it anymore. The distressed homeowner can't pay their bills, so no, they won't pay for your services upfront. Don't take advantage of the homeowner that won't and can't open their overdue bills and mortgage statements. They don't need you to take over the deed to their home. We are doing just fine without you. We can deal with the hardball lenders and 2nd liens. We don't need you deceitful immoral people to ruin our realtionships with our clients and waist the time of the homeowner.
Message for the distressed homeowners, I just pasted below some very important information from Scam Watch, California Association of Realtors® web site legal section, for Realtors®:
"There are companies soliciting homeowners in distressed situations and offering to conduct the short sale negotiations with your bank/lender in exchange for charges and fees. Their interest may not so much be to help you as it may be to try to be the vehicle through which they could “flip” the short sale for a profit.
The key elements for you as a homeowner to look out for are:
1. Short sale negotiators must be licensed real estate brokers (or a licensed real estate salesperson where that person is working under the supervision of his or her broker).
2. Real estate licensees wishing to collect an advance fee in connection with performing short sales must first submit an advance fee contract to the DRE for review and then receive from the DRE the issuance of a no-objection letter relative to that contract. All advance fees collected thereafter under the terms of that contract must be placed in a trust account and handled as client trust funds.
3. Any and all payments must be fully disclosed and made part of the escrow documents. If there are any fees to be paid “outside” of escrow, this may be the red flag that the payment is illegal.
4. If your agent explains that the buyer is a fictitious person or entity or your buyer is purchasing the property under a power-of-attorney or is a limited liability company (LLC), this may be a red flag that fraud is involved in your transaction.
5. If you are told that an unlicensed processor, negotiator or facilitator is handling your short sale, this is a red flag that unlicensed activity is taking place. Only real estate licensees, California lawyers acting as lawyers and investors acting on their own behalf can engage in short sale negotiations."

I know there are tons of agents out there that have experienced mitigation teams or short sale negotiators that wanted to "help" you but really, if you want to do it right. Do it yourself. And only with the help of your broker. That's what they are there for.
