Broker of record with less liability!

California Real Estate Agents wanting to start their own business and operate independently, can do so and be compliant with California Department of Real Estate requirements by working under a California licensed real estate broker, also called a "broker of record".


California Real Estate agents
must work under a broker of record and the duties of a broker of record are to make sure that every contract is done correctly and that all of the necessary forms and disclosures and is also responsible for all actions of the agents that are under the licensed broker of record.

In California, an agent can start their own corporation and have the broker be a broker/officer of that corporation. The broker is actually an "Officer", of the corporation, and has a title such as Vice President. This provides the least liability for the broker and is a way for an agent to start their own company without obtaining a broker's license.

(The broker charges a fee for being the broker of record and the most typical fee I've seen is a $399.00 per transaction/per side fee to the broker or record).

There are specific DRE forms that should be filed to complete the broker/officer status.

In this case, the real estate agent starting their own corporation is responsible for their own errors and omissions insurance and business insurance and must indemnify the broker by name.

The licensed broker should carry their own errors and omissions insurance and the agent over the corporation should have errors an omissions insurance and also have general business insurance and it shouldinclude an indemnification clause to protect the broker.

The broker is still responsible for the accuracy of the forms and must make sure that all of the necessary forms, and disclosures are included in the transaction.

Although a broker can appoint an office manager, who is a licensed agent, to oversee transactions the broker is still ultimately responsible for meeting Department of Real Estate requirements, content, and accuracy of the transaction.

Having a California Real Estate attorney form the corporation and oversee the legal contracts is the best way to prefent any problems and assure that everything is done correctly.

Temecula Gets A Dose Of Celebrity Status

Celebrities Come To TemeculaTemecula gets a dose of celebrity status. Tonight is the night that Gary Sinise holds a fund raiser for a Marine, Lance Corporal Juan Dominguez, who lost both his legs and on of his arms while serving in Afghanistan. Gary Sinise and the Lutenent Dan Band are hoping to raise enough funds to build a special home for Lance Corporal Juan Doninguez that will be custom designed to meed the Corporal's needs. And according to the ticket list that I viewed earlier today, they will do really well!

Those Annoying "Drama King", Real Estate News Headlines

"Drama King", newspaper headlines....they are everywhere and begin something like this: House prices down in December!

This is the headline word for word, that is in today's Californian newspaper, that I get delivered to my house because some scraggly, but nice high school kid needed to sell some subscriptions. I get the Riverside County, California edition and this report was actually about San Diego County.






It was a Case Shiller report

based on statistics from back in 2005 --------------------------->


I don't even know what this article was doing in my Riverside County edition, of the newspaper at all.

In my opinion, the only thing that these annoying headlines are trying to do is to sell subscriptions, keep readers reading and clicking on internet links, and that's about it.

Consumers who want accurate real estate information, need to look at statistics compiled by a real estate professional that can provide information about local trends that include recent sold comparables for the area, neighborhood, type, size of homes they want to buy or sell to determine what is realistic for a value of a particular home.

"Temecula Home Sales" - 2011 compared to 2012


Search For Temecula HomesTemecula Home Sales have stabalized over the last 12 months.

When headlines read...."Housing Prices Drop"! It doesn't mean much in the Temecula real estate market. Here's the results for the last 12 months:

January of 2011 had a median sold price for Temecula home sales of $280,000 and in January, 2012 the medina sold price for a Temecula home was $269,000. However, December of 2011 had a median sold price of $289,000 for Temecula Home Sales.

Temecula median home prices have only flectuated a little bit here and there.


What's most important is to see where the recent sold comparalbes are in the Temecula Neighborhood you are looking at homes.
