Title Insurance - On a Cash Purchase in Oklahoma

Often a buyer that is purchasing with cash, in Oklahoma, does not purchase Title Insurance. This sometimes comes as a surprise to our out- of-the-area buyers.

Oklahoma is an abstracting state. Most of the time the seller in the transaction is paying to have the abstract brought up to date subsequent to the date on the purchase contract. Then the abstract goes to the attorney of choice for the buyer.

In Oklahoma the Title Insurance Policy is written based upon the Attorney's Opinion. Just about everyone gets an attorney's opinion on the abstract which gives his/her opinion as to whether there is good and marketable title. Title issues should come become evident to the buyer by his attorney's opinion. Title flaws are normally the responsibility of the seller to correct unless the buyer accepts the property with the title problems.

So many cash buyers do not purchase title insurance and many that borrow through local banks do not purchase title insurance.

Title insurance can supply you with some peace of mind in your purchase but it's a new idea to many Oklahomans that have always done their financing through local banks which normally do not require title insurance.

I'm not advising one way or the other, simply stating what often is the choice of cash buyers and why it's often their choice.

It's always a good idea to ask about the total cost of certain decisions in any transaction. Title insurance cost estimates can be supplied to you by your title insurance agent. Those cost estimates should include any additional final abstracting, etc that must be done.

I have been told that some closing agents will not close a transaction unless the purchaser does buy title insurance, so that must be weighed into your decicision also.

One of the recent changes in Oklahoma came in 2007
which allows a title insurance policy to be based upon a supplemental abstract if that supplemental abstract goes back to the prior owner's issuance of title insurance. Prior to this time the complete base abstract had to be read each time that a title policy was issued.

It's always a good idea to ask questions. Ask your real estate agent... ask your lender... ask your closer... ask, ask, ask. About all aspects of your purchase. Then you can make informed decisions and hopefully the right decision for you.

I always like to see my clients take steps to help protect themselves whether it's title insurance or a home inspection, using a licensed real estate professional, or a reputable lender. A home purchase is usually a large monetary transaction, so be careful and weigh your decisions carefully.

Equipment and tractors come in to Larry Brinkley's auction from all over, as do the buyers.

The Farm Tractor part of the auction is held on the third Thursday of the month with miscellaneous equipment held
on the following day (Friday). They also have a Salvage tractor and equipment auction each quarter.

They have a nice "fast food" area at the auction with good food that works well at an auction... sandwiches, hamburgers, etc. The ladies that work in theFood Bar at Brinkley's Auction food bar always have a smile for you to go with that hamburger too!

We have purchased tractors, backhoes, trailers, implements, balers, cutters, feeders, and probably a lot more different kinds of equipment at Brinkley's over the years. Having this auction company be located here at Idabel is very helpful to those that live here or live close enough to attend, and can make use of need farm and ranch equipment or tractors..

3 Basic Steps to Obtain FREE Online Aerials & Custom Soil Maps for a Parcel of Land

The Natural Resource Conservation Service (NRCS) online Soil Survey is a great resource for any landowner, real estate agent, developer, or anyone that has an interest in land.

"It has the Official USDA soil information as viewable maps and table for more than 2300 soil surveys..soil maps and data available online for than 95 percent of the nation's counties and anticipates having 100 percent in the near future. The site is updated and maintained online as the single authoritative suorce of oil survey information."

Our office has printed hard copies of the soil surveys for the counties that we work in and they are great.

I prefer the online version anyway because not only can I get Soil Maps, but also Aerials and it has a great measuring tool that tells you the approx acreage.

I use it for both counties that I work in, in Oklahoma, Choctaw and McCurtain.

The Web Soil Survey Site is very user friendly. Most of the navigation tabs are self explanatory.

The best way to learn to use the site is to have some time to play with it when you're not in a hurry and then do just that, play with the maps, menus, navigation buttons.

The NRCS Web Soil Survey Site will tell you the acreage of your AOI (Area of Interest), what kinds of soil are in the area, acreages of each soil type, and it's suitability and limitations for many uses:

  • Disaster Recover Planning
  • Land Classificatons
  • Land Management
  • Military Operations
  • Recreational Development
  • Sanitary Facilities
  • Vegetative Productivity
  • Waste Management
  • Water Management

The Three Basic Steps are laid out on the main page of the Web Soil Survey Site:
1. Define your area of interest
2. Click the Soil Map Tab
3. Use the Shopping Cart (free) to get your report or download it later.


An example:

I used the site for an area of our farm:

Start with the "Start WSS" Green Button their main page.

Then define your area of interest with the AOI button and with the drop down menus on the left side of the page.

The Site will tell you what types of soil are in your AOIs and their acreage.

The Site will also then tell you how well suited that soil type is for different applications and it's limitations in those applications.

This may seem like an over simplified description of the Web Soil Suvey but I'm here to tell you that is simple to use. You can gather a lot of informaiton about your site whether it's for building a house or planting corn. Next time you have questions about the suitability of a particular parcel of land for a specific application, go to NRCS's Web Soil Survey Site. After all it's your tax dollars ar work :)
