Will This Loan Ever Close???

Congress continues to change the way mortgages are done. Effective July 30, 2009, there are several changes that will take place per the HERA/MDIA laws recently passed.

The new laws require the borrower to receive the initial disclosures and have 3 days to review BEFORE we can collect any type of fees. (Including appraisal fees).

Because of the new HVCC (Home Valuation Code of Conduct) - the borrowers now have to charge to a credit card or debit card the appraisal fee. Basically, what the new change means is that we cannot order an appraisal until 3 working days after the initial disclosures have been signed here at our office.

Further, the borrowers will receive "initial disclosures" from the mortgage company when the file is actually submitted. The new law stipulates that a purchase transaction (where financing is concerned) cannot close until 7 business days after the initial disclosures are sent from the mortgage company. Not the disclosures we give them here, but the ones they receive in the mail from the mortgage company.

If for any reason, the fees or loan amounts need to be changed, a "re-disclosure" has to be sent by the mortgage company. That will further delay a closing because if fees change, and a re-disclosure is required, the law stipulates the closing cannot occur until six business days after the mortgage company sends the new disclosures to the borrower.

Traditionally, a closing date is established by the borrower and seller when the sales contract is finalized. While the practice of establishing a closing date at contract signing will continue, please be aware of the MDIA guidelines and the restriction they impose about the time frame of when a transaction can actually close.

We all will survive this market and the sweeping changes that continue to bombard us. But be prepared to hear,"Will This Loan Ever Close"?

Congress & President Kick Tobacco Companies Butts

Congratulations! We've kicked Big Tobacco's Butts! Send Washington a Thank You Note Breaking News: Congress and the President kick tobacco's butts


I'm writing with momentous news! Next week, President Obama will sign the Family Smoking Prevention and Tobacco Control Act into law. Thanks to your support, this law will help save countless lives.

This is a huge victory for the health of all Americans - and a major step forward in our fight against cancer. Just take a look at what the new law does:

  • Tobacco companies must reveal all product ingredients to the U.S. Food and Drug Administration (FDA) and seek FDA approval for any new products.

  • Our nation's children - potential first-time smokers - will no longer be seduced by flavored tobacco products, including candy- and fruit-flavored cigarettes, which will be banned.

  • Consumers won't be misled by cigarettes labeled "light," "mild," or "low-tar" as healthier choices. These terms have also been banned.

  • Warning labels will be clearly visible, taking up at least half of the front and back of cigarette packages.

  • No more public cigarette vending machines in places where IDs haven't been checked.

  • Children will be further protected from tobacco advertisements and sponsorships, which will be banned near schools and playgrounds and at sports or entertainment events. The law also restricts colorful store displays.
It's not easy to stand up to an enemy like Big Tobacco, but that's what Congress did and what President Obama will do next week. That's because there's nothing more powerful than the voices of real people, all across the country, fighting for change that will save lives.

The Congressional Budget Office estimates this law could reduce youth smoking by 11 percent and adult smoking by 2 percent during the next decade. That means there will be far fewer lives lost to cancer caused by tobacco.

Relay for Life

Last Friday night was our first experience at the Relay event at Beech Lake in Lexington, TN.

The community support was amazing as thousands showed up.

Lots of good food and entertainment.

We were a rookie team. Not knowing what to expect.

Our learnings from the event:

1. Lots of work. Recruit more team members next year.

2. If you are serving food, get there earlier and plan to serve the dinner crowd. At around 10:00 most call it a night.

3. Develop a list of things to sell and raise more money during the event.

4. Make it fun. Play games, scavenger hunts, music, etc.

5. Prizes you give away shouldn't be won by anyone in your company. Sorry team.

6. Plan more inspirational and motivational messages. Never forget why you're there.

7. Pack a coat. The lake wind....brrrrrrr.

Looking forward to next year. More prepared, more informed, and more of a contributor.

We are thankful we reached our goal. It was such a rewarding experience.

What's a Homeowner to Do?

You buy your dream home. It's a new, nicely developed subdivision in a small rural community. The road was gravel when you purchased. You were told by the County, the road would be paved when there were three homes in the new development. Now three years, and 20 homes later, your road is still a muddy mess. You figure up the tax revenue collected by the county and it's pushing $50,000 from just your neighbors.

Now, throw in this mix a rule change by the county, that the road must be paved before the county will accept ownership. Now half the road is owned by the county, and the rest by the developer. The developer has agreed to pave his portion, but the county still refuses because they have spent the money allocated year after year to this project. Ten of the first built homes will remain on a gravel road, the newer homes will have a nicely paved road. Just wait until these folks beat down the door at the courthouse.

There are numerous new developments in Henderson County with this problem. The County refuses to address saying they have no money, no budget, no resources to rectify this situation. The citizens of Henderson County, TN. deserve better service and consideration than this. After all, they are hard working, tax paying, good neighbors.

Add to this frustration the amount of taxpayer money allocated to the new county jail. Several million dollar project to give the criminals of Henderson County a Hilton in which to reside. Sorry, mayor and alderman, but most of us don't really care where the criminals live as long as they are locked up somewhere. We do care about the safety and quality of life for the law abiding residents of Henderson County.

Maybe this issue seems petty to the county government, but I assure you, to the new comers to the area who have sought out Henderson County in which to live, who have seen their property values decrease, and their property taxes increase, this is not petty. Paving their roads will most definitely improve their values and make their properties more attractive for resale.

Wouldn't it be wonderful if all the new developments in Henderson County got rid of the mud and potholes. At least those who have been waiting patiently for three years.
