I've been very fortunate to obtain a lot of business from Active Rain and have been rewarded many times over by helping many a distressed homeowner. However, a recent event left me feeling really bad that I couldn't help.
An out of state distressed homeowner found me online here at Active Rain and reached out to me for some guidance. He's part of a young family with just him, his wife and small infant child. He and his family came across hard times and had reached out to his Lender to try to come to a solution. He had been speaking with his Lender about possibly modifying his loan and they were speaking with him about it. They had indicated that they were just waiting on a few more details from new government plans that may aide him. He had a made a usual follow up call to his Lender to check on the status of his loan modification and the Lender said, "...oh, we now own your home as it was just foreclosed on...." "What...", he asked. He had never received anything in the mail or over the phone to indicate that his home had been foreclosed on. Talk about having the rug pulled out from under your feet. Could you just imagine the grief he felt at that very moment.
Days later, he received a Realtors business card on his door and called him leaving a message. The Realtor returned his call to tell him of his options. The Lender was going to offer him $500 if they would move out of their home within 30 days. $500 wouldn't get him anywhere and he had no idea where he would go in 30 days.
I had asked him why he didn't consider a Short Sale. He replied, "What is a Short Sale?..." Oh my gosh! Why didn't he know all of his options, particularly the benefits of a short sale. ( Find out more if you qualify for a short sale ) I say this time and time again, that distressed homeowners aren't in the know when it comes to the benefits of a Short Sale. We hear about the rise in foreclosures here and there, the causes of foreclosures... but not enough is being said about the benefits of a Short Sale. Why didn't the Lender let him know that a Short Sale might have been an option?
It's awful enough to hear of this family's misfortune and that I couldn't help this time yet distressed homeowners should know what their choices are when it comes to being faced with a foreclosure. Why not require that all homeowners be served with their options when a foreclosure is pending. Most will get served with a notice of foreclosure. Why not include with that an easy to read fact sheet?
My prayers go out to families like this young family as it shouldn't have happened this way.

I just recently obtained a Short Sale approval on a unique Short Sale scenario and it was completed really fast - in 29 days. I've been so busy with getting offers on my Short Sale Listings and getting approvals on my Short Sale Listings that I'm happy to say that I just love working with Short Sales and getting them closed.
This homeowner was a bit different in that the home had already been through a bankruptcy and the homeowner had its debt discharged yet she wanted to do the right thing and try to sell it.
The process was a bit different in that the Lender didn't need to see the Seller's finances even though they tried to obtain it yet I reiterated that it was not necessary as this debt has already been discharged. They agreed and sent it off to PMI for approval and PMI tried to gain financials and I again stressed that it wasn't necessary and they ultimately agreed. Shortly thereafter I gained an approval. I wondered what would have happened if the offering price wasn't within fair market value....would they have denied the sale even if the debt was discharged? Would there have been a point in which they would have said "no".
They went through the same basic approval process regiment of obtaining an appraisal and we were within the fair market value from the appraisal and all was good.
Happily the Buyers received a home that has long been on their "wanted" list as they had looked at the home many years before and when they saw it came on the market they wanted to immediately snatch it up! So once again, a happy outcome for all concerned on a successufl Short Sale approval. Relieved Seller, Happy Buyer, "Off the books" Happy Lender and "rewarded in more ways" Realtor.
Now I'm off to tackle the next Short Sale and very happy to do so!

I have a Buyer who found me after searching for a Realtor who specializes in Short Sales. She is keenly aware of the fabulous values available with a Short Sale - that is, if you get a Listing Agent who wants to actually get a house sold. Could you imagine...is there such an Agent who would list a house for sale but have no desire to sell it? Apparently so, as I'm dealing with one currently.
His head must be stuck in the sand somewhere.

I submitted an offer to a Broker who has his own Real Estate firm named after himself. I spoke to him prior to sending the offer to confirm that there were no current offers on the home and to let him know that it would be coming. Told him the offering price, okay not a bad offer, within fair market value, not a low ball offer and a pre approved Buyer, a conditional approval given not a pre qualification but a strong Buyer. And nothing, nada, no response, no return email, no return phone call. WHAT? Hey, if he didn't like the offer, pick up the phone, send an email or at least tell me to fly a kite, but something, some type of acknowledgment would be nice. What on earth goes through some Agents mind? Why did he list the house for sale without the desire to sell the home. Where did he learn that skill? So why do so many people think Agents can be shady? It's always the few bad apples that spoil it for the rest of us who go out of our ways to be a customer advocate. It is just so maddening to me.
It's a nice home too. It could easily be sold as it really is move in ready. A perfect Buying opportunity!
What's worse is that the Seller thought they found the perfect Agent to sell their home, to save them from foreclosure, to put their nightmares behind them to get on with their lives. HALT....wait....not so fast with this type of Agent. There is no accountability by this Agent. Who is holding them responsible for the lives of another? Nobody does and how can we. There really should be a way for them to be held responsible. It just makes me ill. All too often, bottom feeders come out when people are at their weakest. Geeze, how can they stand themselves. I wish there was something that I could do.

What? Yes, there are Buyer's Agents with this mentality running rampant. With all the talk you hear of Code of Ethics within posts, I would say a Real Estate Agents's ethics would be questioned if they do not show Buyer's listings that are marked as a Short Sale.
I was fortunate enough to benefit from receiving a customer recentlly who found me on line because she wanted to look at Short Sales and her Agent wouldln't show her any Short Sales. Yes, you heard me, the Agent wouldn't show her any Short Sales. This is wrong, dead wrong.
Points perhaps taken by the Buyers Agent is that Listing Agents who aren't knowledgeable in Short Sales will not help their Buyers close on a Short Sale which leads me to question whether or not Listing Agents who take on Short Sales listings are putting themselves in a position of others questioning their ethics practices when they knowingly accept a Short Sale Listing without taking the extra efforts needed to arm themselves with the skills to fulfil a Short Sale closing.
Hmmm, so who is more of a detriment to the customer?
The Buyer's Agent or the Seller's Agent. Arguments from both sides clearly have their place. How are Agents making their choices when it comes to customer representation?
What it really boils down to however is ones conscious. How can you do what you do and sleep at night? These types give this profession that I view as being an honorable profession, a dirty name. I say clean up your act!

Incredible to say the least!
I've had a Short Sale listing that has been on the market for months. A young family struggling. We'd get notice of showings and the majority of the Agents never even showed up or even bothered to call to cancel a showing; talk about the homeowners losing faith in the hopes of getting out of their awful financial situation. Suffering through despair and depression I had recommended that they attend my church to find some peace in God's word. They had considered but never went.
After months of no offers, I received a call from an out of the state Buyer looking for a home for a family member and they liked my listing that they found online of this young family's. The Buyer indicated that their family member was in training at a local church and they wanted to purchase a home for them to live in that would be close to the church. They gave me the address of the church and oh my, it was my church; my church that its Pastor has communicated such astounding words of God to me. In fact, they were family of one of the Pastors.
The whole time that this communication was taking place between myself and the out of state family, the family had family members living here locally and they thought that they would drive by the Short Sale home for sale to get a closer look. As they drove by, the homeowner happened to be outside the door shaking a rug. The family asked if they could take a look and the homeowner, desperate for a Buyer, said well "okay" but don't let my Realtor know that I let you in." (I had told her not to let just anybody in) She let the family in, they liked the home, introduced themselves as being family members of my church and that they should try visiting the church. The homeowners said, "...yes, our Realtor has told us about Church by The Glades and that we should go but we haven't yet..."
Welll, fast forward, the family has put in an offer on my homeowners home, the homeowner have gone to my church and experienced a service that seemed to have been speciallly prepared just for them plus they visited the church the following weekend and have loved it! It all seems to have been part of the plan. I couldn't have orchestrated a better plan if I tried - really something, isn't it?!
