You must be really good at catching the CURVE BALLS of Short Sales if you want to survive.

Sometimes I wonder if I would love doing Short Sales if there weren't for the curve balls. I wonder what that says about me?! It must be the challenge that I love; the point at which you come to a screaching halt in the Short Sale approval process when somebody or something says "no".

Well, it has happened on a recent Short Sale here in Coral Springs. I had received written approval from the Seller's Lender for the sales offer, the Buyer's inspection was completed, the Buyer's appraisal was completed but oh, wait a minute....the appraisal from the Buyers Lender undercuts the sales price. Yes, not so smooth sailing. So back to the Seller's Lender with a new estimated HUD and market analysis to support the Buyer's Lenders appraisal. Recent sales in a ever declining south Florida market lowered the fair market value. Seller's Lender orders a new BPO to verify new appraised value provided by Buyer's Lender. So back to waiting.

The Seller had begun to pack up, the Buyer was counting the days to get into their lovely new home and WAIT....Oh, how I love the ever challenging Short Sale.

I recently earned the designation of CDPE - Certified Distressed Property Expert.

I have chosen to do all that I can to help out the distressed homeowner save their home from foreclosure; I do this by listing their home for sale as a Short Sale and selling it prior to the home being foreclosed on. I do not charge any fees up front to get the home sold as a Short Sale as I earn my commission that the homeowner's Lender agrees to pay at closing.

Consider a Short Sale, a Short Sale is when your Lender agrees to accept less than what is owed on your mortgage.

ANSWERS to the Short Sale Quiz

So How do you think you did? Do you know Short Sales like I do?

  1. A Short Sale is better than a foreclosure. True or False?

TRUE: A Short Sale will lessen the adverse effects to your credit and put you in a more favorable buying position for the future. In fact, FHA guidelines will consider a Short Sale borrower within two years of having the Short Sale. We all know how fast two years can fly by.

2. I must be late on my mortgage payment to qualify for a Short Sale. True or False?

FALSE: These seems to have been commom practice some time ago, however Lenders no longer demand that you miss your mortgage payments to qualify for a Short Sale. It is the demonstration of a hardhip that your Lenders are looking for.

3. Using a Realtor that has been in Real Estate for years and years doing traditional Real Estate transactions can do just as good a job if not better than a Realtor who specializes in Short Sales. True or False?

FALSE: There's no denying that a Realtor who has been in the business for years and years is knowledgeable about Real Estate. However, it is not a given that they know how to effectively handle a Short Sale for success. A Realtor who has demonstrated the knowledge of Short Sales with successful closings will far succumb to a Realtor's years of Real Estate experience. Short Sales is a whole new arena within Real Estate and having someone knowledgeable to support you will determine your success rate in avoiding foreclosure.

4. I must be living in my home for my Lender to allow me to sell my home as a Short Sale. True or False?

FALSE: Similar to #2 above, this used to be the norm with Lenders. However, they have loosened this requirement and it is no longer a requirement for all Lenders. Again, demonstrating hardship is key.

5. I must pay the Realtors commission in a Short Sale. True or False?

FALSE: You do not have to have the money to pay your Realtors commission. Your Lender will approve the amount of commission to be paid to your Realtor and that amount will be reduced from the Purchase price of your home at closing.

6. My Lender will not allow any Seller contributions towards the Buyers closing costs. True or False?

FALSE: It is all about what the Lender will net and if there is room for your Lender to meet their net requirement, then they will authorize a seller contribution. It's all in the numbers.

7. I cannot sell my home as a Short Sale if I'm past due on my Homeowners Association fees. True or False?

FALSE: When you sell your home as a Short Sale, an estimated settlement statement (HUD-1) is prepared to let your Lender know of all the costs associated with the sale. If you are behind on your Association dues, then the amount you are past due will be included on the HUD-1 and your Lender will approve to pay them, thus reducing their net amount from the purchase price. This is quite common and is more often than not, approved.

8. I can pretty much guarantee that I can buy a Short Sale home from a distressed Seller for way below fair market value as the Lenders are taking anything my friends say; say 50% below. True or False?

FALSE: Just get this thought right out of your head. Lenders will look at a fair market value range to determine the purchase price that they will approve. Know that your friends are giving you bad advice. Your offering price must be within a fair market value (FMV) range and how far away from this value, what percentage from FMV is determined by the Seller's Lender.

9. According to HUD, if I had an FHA appraisal on my home completed 6 months ago in a pre foreclosure sale, they will not do another appraisal even if fair market values have declined. True or False?

FALSE: Not too long ago I wrote a post on this very issue, however since that posting I have gained the knowledge that this isn't true. According to HUD letter 08-43, a new appraisal can be ordered to ensure that the most current FMV is used for a preforeclosure sale even if an appraisal was completed within the 6 month period.

10. An FHA Appraisor completed an Appraisal on my home; too bad my Realtor can't be provided with a copy of it. True or False?

FALSE: Dont' let your Lender tell you this. FHA does allow the appraisal to be provided to the Sales Agent. Ask for it. Don't let them pull the wool over your eyes.

11. I have a lien on my home and I don't want to tell my Realtor about it as I'm just so embarrased about all of my delinquencies. I hope he or she doesn't find out as it won't matter anyhow. True or False?

FALSE: This is one of the worst things you can do as a homeowner. It is critical that your Realtor is aware of all deliquencies so he or she can be sure to include them on the estimated HUD-1. If you have any type of liens against your home and they aren't found out until closing date, you can kiss your closing goodbye. Your Lender must know of everything when the offer to purchase is submitted to them. This ensures that they know what their net will be. Trying to get them to further reduce their net once they have approved an amount is not left for the timid; it's tough to get through.

12. Using a Short Sale Company to handle my Short Sale is better than letting a Realtor handle it; after all you pay for what you get and having to pay $1200 upfront has to be a sign that they know what they're doing. True or False?

FALSE: Having to pay a fee to a Short Sale company does not guarantee success. What you must consider when selecting someone to handle your Short Sale is their knowledge; do they know what they're doing. Having to pay a fee up front doesn't guarantee that. I do not charge any fee and have been very successful at a high closing ratio. Many do charge a fee. It is your choice whether or not you pay an upfront fee. Just know that because you do will not guarantee a successful closing. It is your decision whether or not to pay a fee. You must be comfortable in the choice you made.
