Council declines request to change City Plan, an article from The Colorodoan, reports that council members declined city staff's request for direction to change the City Plan to accommodate what it calls inevitable retail growth along I-25. Mayor Pro-Tem Kelly Ohlson said, "I am supportive of moving forward and discussing all of the (interchanges), but we need to have more information about that before we can move in any direction. I would like to know if (any proposed changes) conflict with other areas of the City Plan." City staff told council members that replacing the interchanges being dubbed "gateways" to Fort Collins is a key component to any retail development, adding that growth projections show there is room for another retail hub in Northern Colorado - a hub that developers will most likely want to put along the highway.

Rising foreclosures pressure housing prices, an article from MSNBC.com, reports that a growing share of home sales are from foreclosures, especially in states hardest hit by the housing bust. Real estate experts say the growing proportion of foreclosure sales is both a symptom and cause of worsening conditions in the weakest housing markets. Their reasoning is that homeowners who aren't on a deadline to sell are pulling their properties off the market, and the remaining inventory is increasingly held by banks eager to unload foreclosed properties at fire-sale prices rather than carry the costs on their books. Although foreclosure sales are bad news for homeowners in neighborhoods with high foreclosure rates, they are a boon for well-financed buyers looking for properties at bargain prices. And in broad terms, economists view them as part of getting back to more realistic prices after years of excess. Walter Molony, National Association of Realtors spokesman, said in an effort to get a handle on the scope of the problem, the National Association of Realtors is conducting an informal survey of the issue and is planning to release findings later this month.

Update on HB 1161 and HB1165
HB 1161 and HB 1165 are steadily working their way through the Colorado General Assembly. HB 1161, sponsored by Rep. John Kefalas (D-Fort Collins), Rep. Randy Fischer (D-Fort Collins), Sen. Steve Johnson (R-Fort Collins) and Sen. Bob Bacon (D-Fort Collins) would provide protections for ground water impacted by in situ leach uranium mines.
HB 1165 is also sponsored by Rep. Kefalas and Rep. Fischer, along with Sen. Brandon Shaffer (D-Longmont) and Sen. Bacon and would ensure local government authority over mining operations that threaten water quality or public health. Both bills have been assigned to the House Agriculture, Livestock and Natural Resources Committee.

Greeley Tribune Endorses HB 1161 and HB 1165
Excerpts from Tribune Opinion published on February 10, 2008:
...A fight is well under way over proposed uranium mining near Nunn in north-central Weld County. It's the big industry -- Powertech Uranium Corp., versus the little guy -- the farmers, ranchers and residents in the area, concerned the mining will contaminate their ground water...
...Time and time again, mining companies have assured their operations would not affect the environment or residents' quality of life. Unfortunately, time and time again, they have failed...
That's why the government must do all it can to protect residents from potentially harmful mining operations. We support two bills currently before the Colorado House that would take a first step toward doing just that.
House Bill 1161 would require that companies such as Powertech clean groundwater to pre-mining quality after it finishes operations. House Bill 1165 would give local governments more control over what sort of mining is allowed in their communities.
It is essential that state and local governments have the power to oversee application and operation of mining operations. It must have the power to protect residents...

Many of Fort Collins' finest musicians, singers, songwriters, and bands are participating in the upcoming concert, organized by Lloyd Drust, to support efforts in opposition of uranium mining in northern Colorado. It will be held at Avogadro's Number (605 S. Mason) in Fort Collins. The concert starts at 10am and goes to 7pm. The concert is free, but donations are welcome, 100% of which will be donated to C.A.R.D. The following performers have graciously given their time and talents:

Yesterday was a long day. We got home at 9:30pm. It certainly gave me a great amount of appreciation for the jobs that our Elected Officials have in front of them. HB1161 had it's public hearing in front of the Agriculture, Livestock & Natural Resources Committee. The bill was introduced by Randy Fischer and John Kefalas and lists these sponsors:

The committee heard almost 30 testimonies. Most of them against the bill by the mining industry, 2 Powertech attorneys, George Robinson from R squared, Dick Clement, and I know at least one other Powertech rep, but I had to step out of the room for a while while they paraded their people (I'm sure you can all understand why --- siggghhhh.) The Colorado Mining Association spoke in opposition as well as some out of state mining experts who said this bill will have repercussions around the globe. (WoooHoooo!!! Why shouldn't the mining companies have to clean up their mess)
We met some people from Fremont County who are getting organized because of a threat of in-situ and hard rock mining adjacent to their million $$ homes. (Funny thing, they are already seeing their property values in huge decline - hmmmmm)
Jeff, Lilias, me and one woman from Fremont County all had very compelling testimony in favor of the bill. Matt Garrington from Environment Colorado testified in favor as well. We were definitely out numbered in bodies in opposition, but the sense was that the committee was getting very tired of the same old "rap" from the U miners and the mining industry. Our strategy of being low key likely worked in our favor.
Also speaking in favor of the bill was Dr. Cory Carroll (Speaking for the Colorado Med Society and Larimer County Med Society), Larimer County Commissioner Randy Eubanks, and a representative from CCI (Colorado Counties Inc.)
Marsha Looper gave me a big hug and thanked us all for what we are doing. Kathleen Curry called Dick Clement on the carpet by telling him that people do not approach the capital with a bill unless they are at their wits end. He might want to examine how his company is doing business. I saw Dick's ears turn red on that one...... He proceeded to defend himself by telling her we are just all anti-nuke activists (my summary of his words - interesting how not one of our testimonies mentioned nukes. Just water.) Buffie McFadyen shared a story of a family member who is sick from heavy metal poisoning because of the U tailings in her district. Wes McKinley thanked me for our efforts, as well.
The mining industry is doing their best to sell their position to the committee as a property rights issue (they own the minerals and should have the right to go after them), as well as talking about how they are helping the groundwater to be cleaned up by taking the uranium out (these same testimonies also talked about how the groundwater could never be used as a drinking water source after the mining is completed - Oh yeah, they are making our water better alright.) They also talked about how much $$ they pump into the economy. They are selling the fact that the regulations are already great, varied and in place to protect the health and safety of people and the environment, so "please don't muddy the waters by adding one more piece of law." (my pun)
Everyone - PLEASE TAKE ACTION Call - write - e-mail.... whatever you can do. My gut says that we need to especially hit Sonnenberg, McNulty, Rose and Gardner with strong words about how polluted water will effect OUR property rights. Even if these guys are not your reps, they are serving on this committee that is in place to represent the entire state, so they deserve to hear from you. Tell them your personal stories. Tell them how close you are to any proposed uranium mining site. I have no strong feel either way for Scanlan, Hodge, Curry, or Gallegos. They need to hear from us too, but maybe not as strongly worded. Encourage McKinley, McFadyen, Fischer, Looper and Solano to stand strong. Again tell them all your personal stories. These are very effective right now. We have rights as well. We have rights to clean water and right of use of our property and right to health and safety.

The Bill is in amendment phase right now. It will be re-heard and voted on on 2/6/08. Contact all these people ASAP and often. Spread the word......
