Before You Buy Check for Restrictive Covenants

You've just toured the home of your dreams and are ready to make an offer. You can already envision upgrades you would like make: a pool in the back yard, window shutters and a black picket fence to match. You're even excited that your boat will fit in the driveway. Yet, what you may not be aware of is that there are restrictions that dictate what can and cannot be done to or on the property.

Homebuyers, especially first-timers, may not think of asking about restrictive covenants, yet when you purchase property governed by restrictive covenants, you are consenting to abide by those provisions.

A restrictive covenant, which is a type of deed restriction, regulates a group of new and existing homes or building lots. Developers use them to preserve a development or subdivision as a model community and control its use and appearance. Buyers agree to the sometimes-rigid restrictions in order to maintain the aesthetic standard set by the developer and to safeguard the value of their homes.

Restrictive covenants should not be confused with local zoning and government regulations. Some covenants and zoning regulations overlap; for instance, either can limit the height of a building. But, restrictive covenants tend to exert greater control over a homeowner's lifestyle. In addition to standard clauses, which may stipulate a home's minimum size, height, architectural style, and color schemes, covenants often ban practices that could be regarded as aesthetically objectionable--such as parking RVs, boats and non-running vehicles on the property.

Covenants may additionally regulate grass height; window treatments; holiday decorations; walls, fences and hedges; as well as pets--some limit number and type of pets allowed. Very often, owners are required to make repairs within a specified number of days of the initial notification. Depending on a community's location and other unique features, restrictions may be applied to the use of pesticides, herbicides and fertilizers and removal of dirt and trees. Owners can be prohibited from installing solar panels, building an enclosed patio or adding a swimming pool. Restrictive covenants can also prevent owners from renting the home or operating a home business, including music lessons and daycare. Condo and townhouse owners sometimes face even more rigid restrictions.

What happens when a violation occurs? It's up to the homeowner's association or individual property owners to enforce a covenant. Local authorities cannot enforce contractual agreements. Instead, it's likely that a committee would review the complaint, then notify the homeowner. If the homeowner ignores the initial notice, he or she might receive a notice from an attorney. Legal action would be a last resort.

Before You Buy

While most homeowners enjoy the quality of life resulting from restrictive covenants, some covenants may prevent you from living the life you planned. Before committing yourself to a property, be certain you can live with all the restrictions.

•· Ask to see a copy of the restrictive covenants prior to taking a trip out to a property. You may be able to eliminate the house from your "To See" list.

•· If the sales professional didn't have the document available initially, be certain to review a copy of the restrictive covenants prior to making an offer.

•· Or, make your offer contingent on your review and approval of the restrictive covenants.

MEDFORD LIONS RECYCLE FOR SIGHT

Medford, MA - October 15th, 2009. As Fall/Winter cleaning season gets underway, the MedfordLions Club is asking people to look through drawers and closets for old, unwantedeyeglasses and donate them to the Lions Recycle for Sight program.

During the month of October & November, the Medford Lions Club will be collecting used prescription eyeglasses and sunglasses as part of a uniquerecycling program throughout theUnited States and Canada. The glasses will be distributed to those in need in developing countries where eye care is often unaffordable and inaccessible.

"We need everyone to donate their old glasses," said Matt Hollis Medford Lions Club president. "In most developing countries, an eye exam can cost as much as one month's wages, and a single eye doctor may serve a community of hundreds of thousands of people."

The glasses will be shipped to one of ten Lions Eyeglass Recycling Centers where they will be cleaned, categorized by prescription and prepared for distribution by Lions and other groups. According to theWorld Health Organization, the eyesight of approximately one-fourth of the world's population can be improved through the use of a corrective lens.

To donate used eyeglasses, place them in specially marked Lions Recycle for Sight collection bin located in Prudential Prime Properties Wolfson Cutler Real Estate - 366 Salem St. Medford, MA.


When Donating Eyeglasses

·Please send both plastic and metal frames. Remove loose and broken lenses or damaged lenses and frames. Rather than store glasses for a long time, send as soon as possible to one of the Lions Eyeglass Recycling Centers. Time, extreme temperature and weather conditions cause damage to frames and lenses, often rendering them useless.


·Pack eyeglasses in a sturdy corrugated cardboard box. Layer rows of eyeglasses with tissue paper, newspaper or styrofoam. (Please avoid using shredded packing materials or styrofoam "peanuts.")


·Seal box with strapping tape.


·Be sure label is legible and include your return address.


·Used eyeglasses are of no commercial value; therefore, choose the least expensive means of shipping to the recycling centers (usually third or fourth class mail.) Label the box, "No commercial value."


·Please notify the Lions Eyeglass Recycling Center before sending large shipments of eyeglasses.

Important FHA Property Tips

FHA PROPERTY TIPS

1.) Prohibition on Property Flipping

· All properties must be purchased from the owner of record and cannot involve any sale or assignment of the sales contract


· If the seller/owner of record has owned the property for 90 days or less from the date of acquisition, the property is NOT eligible for a mortgage insured by FHA. The date of acquisition is defined as the date of settlement on the seller's purchase of that property. The resale date is defined as the date the new buyer signed the sales contract; Exceptions include resales by relocations agencies, resales by employers to employees; sales of HUD owned properties, inherited properties and real estate owned sales by other federal agencies. Foreclosures with purchase agreements signed on or before May 10, 2010 are also exempt from the requirement.


· If the resale date is between 91 and 180 days: a second appraisal will be required if the resale price is 100% or more over the price paid by the seller when the property was acquired; the second appraisal cannot be paid by the buyer.


· If the resale date is between 181 days and 12 full months: a second appraisal or other additional documentation MAY be required at the lender's discretion if the resale price is 5% or greater than the lowest sales price of the property during the preceding 12 months.


2.) For 3 and 4 unit properties, FHA requires them to be self-sufficient, regardless of occupancy status. The maximum base mortgage amount is limited so that the total estimated fair market rent for all units, including the proposed owner occupied unit, less the 15% vacancy/maintenance factor for this area, must be greater than or equal to the proposed PITI for the subject property. Three months PITI reserve is also required.

3.) Properties having a private well and/or septic system will require connection to public systems whenever feasible. This requirement can be waived if the cost is documented by a plumber/professional and it exceeds 3% of the value of the property. A satisfactory Title V certificate is required in Massachusetts

4.) A domestic well must be a minimum of 50 feet from the septic tank, 100 feet from the septic tank's drain field and a minimum of 10 feet from any property line.

5.) Any nonresidential use of the property must be subordinated to its residential use and
character. A property, any portion of which is designed or used for nonresidential purposes, is eligible only if the type or extent of the nonresidential use does not impair the residential character of the property. Areas designed or used for nonresidential purposes may not exceed 25% of the total floor area, including storage areas or similar spaces that are integral parts of the nonresidential use.

6.) There are no limitations on the number of properties a borrower may own. However, the borrower may not have more than 1 open FHA mortgage at one time. Some exceptions to this rule do apply and can be considered on a case-by-case basis. The owner occupancy of the new FHA mortgage request must make sense.

7.) FHA limits the LTV to 85% on Identity of Interest transactions. An Identity of Interest transaction is defined as a sales transaction between parties with family or business relationships. Financing above 85% is allowed under certain circumstances.

8.) Non-occupying co-borrowers are allowed but are limited to single family properties only, if the LTV exceeds 75%. Non-occupying co-borrowers must be related by blood, marriage or law, or for unrelated individuals that can document evidence of a family type, longstanding and substantial relationship, not arising out of the loan transaction. If a parent is selling to a child, the parent cannot be the co-borrower with the child on the new mortgage unless the LTV is 75% or less.

9.) Effective with all case numbers issued on or after November 2, 2009, FHA condos must be on FHA's approved list or must be submitted to HUD for approval. Condos currently on the FHA list must also be 51% owner-occupied, must not be subject to special assessments and pending litigation.

10. ) If the dwelling or related property improvements is located within the fall distance of a high-voltage transmission line, radio/TV transmission tower, cell phone tower, microwave relay dish or tower or satellite dish - the property is not eligible for FHA financing.

11.) Dwelling or related property improvements located within 10 feet of a high pressured gas transmission line easement are not eligible for FHA financing.

12.) If the property is within 300 feet of a stationary, storage tank containing more than 1000 gallons of flammable or explosive material, the property is ineligible for FHA financing

13.) Fuses and/or circuit breakers are acceptable as long as minimum electrical service is 60 amps.

Hi,
I got a call today for a little older lady whose gas stove went bad today. She was wondering if anyone reading this and in a reasonable proximity to Medford, Massachusetts would be throwing out a gas stove. Anyone remodeling & upgrading & looking for a way to get rid of the old would make this woman very happy.

We have the plumber who will come & remove it properly, and a trucker who will haul it away. Any assistance would be greatly appreciated.
