Happy ending story in Arizona.
Not too long ago I have posted a blog about homeowners, who strip their houses just before home goes to foreclosure with a strong feeling they have the right to do that. Such an act is qualified as illegal and may be prosecuted.

Just recently in our company meetings one of our fellow agent mentioned a heart breaking story, showing that not every homeowner belongs to the same basket in given situation. Some people take proud of ownership to the end.
There was a family in a city of Arizona (as many today) facing financial hardship and could not afford house payments anymore. Their home went to foreclosure. The agent that supposed list their home on the market as REO property arrived to the address at THAT date, and found the husband finishing manicuring the front yard and his wife mopping the floor. They wanted to hand the key to the agent with dignity of responsible homeowner. They could not keep the house anymore but sure knew how to take care of it to the last day. They wanted to leave their home in mint condition for a future owner.

It turned out, that the agent being so surprised with their generous and kind behavior, hired the husband as part of his maintenance crew and wife as made for preservation of REO properties.
It is one of very few of happy ending stories.

I visit many homes after Trustee Sale with interested Buyers and wonder at what I might find indoors when I put the key into the lock. The last foreclosed home I toured had exceeded my expectation and imagination. I have seen a lot properties with missing:
When homeowners do leave their property, they do not always simply "walk away." Do they?
So, after a while I got used to it. Just warned my buyers what they can expect inside foreclosed properties.
What was done to home I went to recently in Maricopa, AZ just shocked me.
The homeowner must have been so furious and ready to take on the structure he lived in for at least few years. Inside the house we discovered purred CONCRETE into the toilet and bath drainage!!!! What a courage... to get the material and pay for it, invest a time and effort to prepare the mixture and fill in the drainage! GOAL achieved! The foundation must be ripped off and the entire drain pipes replaced. House do not qualify as livable (at least not up to FHA standardsJ)
Homeowner was probably having a bad day.

Some misguided home owners, angry at the bank for foreclosing, think it's somehow permissible to turn the home into a total nightmare. It is ILLEGAL. Banks are most likely to pursue and prosecute homeowners who vandalize or strip their homes while in foreclosure.
But does it really happen? Personally, I have not heard of any legal action against homeowner who stripped or demolish his house while in foreclosure.

SCAM ALERT: Check Your Vacant Listings

The Arizona real estate local MLS has issue an alert for listing agents in regards to scam that may be going on in the valley. I believe that is a valid warning to be pass on to others as well.
A recent scam involves tenants moving into a pending short sale listing. The surprised listing agent contacted the owner who had not rented the property to anyone. The tenants (two women with two children) were physically moving in and had turned on utilities in their name. The sign and the lock box were removed, and all locks were re-keyed.
The tenants responded to a FOR RENT sign in the yard. They gave someone $1,800 as rent and signed a lease. While the short sale was able to close, the unfortunate victims of this scam were out $1,800 with no place to live.
This down economy encourages some people to take advantage of others. Listing agents should check their vacant listings regularly and provide neighbors their contact information in case they observe any suspicious activity.
