I want to get the word out to my fellow agents. Please don't ask the buyer or buyer agent to verify the existence of a ground rent on one of your residential listings. Under Maryland law the seller must disclose the ground rent amount, payment date and owner of the ground rent to the buyer using a special form that gives a warning and notice to the buyer regarding ground rent.
Just about every REO listing I see says that it is the buyer's responsibility to verify. I believe that not informing the seller of their obligations under the Maryland ground rent notice law and not verifying compliance would be a violation of the law and may put you at risk for being disciplined by the Maryland Real Estate Commission.
Lets get the word out about this. The law has only been in effect for over a year.
Required Notice of Ground Rents - HB 502/SB 398 - Passed
Requires an owner of residential property to disclose, among other items, whether the property is subject to a ground rent; the cost of the ground rent; the "owner" of the ground rent; and the address where payment of the ground rent should be made. Signed by the Governor on May 8, and effective July 1, 2007.

In my market area Coldwell Banker Residential Brokerage just closed their Dundalk office. This office had been at their Merritt Boulevard location for quite a while mainly as an O'Conor, Piper & Flynn office. At one time this office was considered to be very successful. The agents were given about a week's heads up before closing down the office.
What happened?
Many of the successful agents that used to work with that office moved on to other companies. Some of the old timers weren't selling much any more but the real change is in the real estate business. In the last 6 months the office of about 40 agents was closing only about 8-10 transactions per month.
Agents don't need a big company office. Technology has made many of the services that large offices used to provide irrelevant. Real estate agents don't need a big company image either and they certainly don't need to pay for any of these unecessary items through the form of their commission split.
All real estate marketing is personal and agents that market the company before themselves are leaving the real estate business by the hundreds. Agents that want to stay in the real estate business need to learn about marketing and learn how to service their clients properly. Agents need to learn how to build their own professional real estate practice like a dentist or lawyer would. The real estate business always has and will always be a personal service business.

Unfortunately in every business there are people who cut corners and bend the rules. Here is one way that you can get screwed whether you are buying or selling at auction.
Phantom Bidding
A phantom bid is not real. A phantom bid is where an auctioneer increases the price of the property for sale but the auctioneer does not have a real bid to justify the increased price. Most auctions are public sales to the highest bidder. When an auctioneer ratchets up the price of the real estate without having a real bid, it is fraud. Unfortunately, it is very difficult to spot phantom bids. When the sale is over the crowd breaks up. Since there is no paper trail until a contract of sale is signed, some shady auctioneers think that they can call phantom bids with impunity. Some auctioneers may also have a "shill" in the crowd whose sole purpose is to drive the price up or drive the price up to the "reserve price". The shill is not a real buyer and is not prepared to buy the property even though they are bidding on it.
Be careful when attending an auction. You might want to take an auction buddy that can stand back and see who is bidding and to keep an eye on the auctioneer. Don't be the happy high bidder who paid too much because he was the only one bidding!
Every day I am amazed by the number of Baltimore City properties that have showing instructions of "use screw gun for entry". Do the listing agents and sellers actually expect other agents and their buyer clients to carry around a screw gun and take the boards off of a property to show it? Adding to the difficulty is that many of the boards are glued very securely and have square head screws, instead of a typical "phillips head screw". What do they think the homeless people carry screw drivers in their back pockets when looking for a place to crash? Most of my investors skip the boarded properties that don't have easy access unless they are grand slam home run deals.
I have determined by counting my fingers and toes and guesstimating that a boarded property probably sells for approximately $10,000-15,000 less than a similar home with a proper front door with lock box.
Mr. Seller, why not invest $300.00-500.00 to put a front door on your lovely row house? Who knows you might even sell your house for your overpriced asking price.
