The Desirable Hawthorn Hills Community

Hawthorn Hills, Hendersonville NCHawthorn Hills has always been my favorite in the area. Early on in my career, Hawthorn Hills used to be my farm area which I use to market. I sold quite a few houses in here and have encouraged my new clients from out of town to take a look.

Hawthorn Hills is located about a mile out of Laurel Park on Highway 64 West. It is very convenient to nearby shopping. In fact, downtown Hendersonville is only about 3 to 4 miles away. There is approximately 104 houses in this subdivision, which are all different architectural designs on at least 3/4 to 1 1/2 acres of property. William Pitkin was hired to plat the roads and the lots. Mr. Pitkin was a well known architect that was responsible for laying out Shaker Heights in Cleveland, Ohio. After walking the acreage, he remarked that he had never seen so many hawthorn trees in one place. Hence, the name was created for the new subdivision.

The property was owned by Bert & Sara Browning who had a dairy farm called Kalmia Dairy. This was a processing plant which purchased milk from many Henderson County farms to supplement the production of its own small dairy farm. The Brownings bought several small farms in the area and named the new acquisition the Mayfields Farm. During the summer, in one of the barns on the premises, square dancing was enjoyed on a regular basis. During WW II, German prisoners were held in a camp here in Henderson County and groups of them were sent out to work on farms. While redesigning the front entrance, Burt discovered initials of the P.O.W. on the concrete heading of the culvert under the residence of the house that faces Highway 64. Just a bit of history about this classic subdivision that you might find interesting.

Presently, there are 7 houses on the market which really is remarkable for this well sought-after community. I'm sure it is a sign of the times and also a lot of residents have lived in their homes for many years and it is time to transition to something smaller.

Phase II was established in 1993, where today there are about 14 homes with their own HOA. This is an impeccably landscaped and well maintained subdivision with two ponds and lots of open spaces. The residents are very proud of their homes and it really shows whenever I bring my clients for a tour.

I Hate Change!

Wow, I just came out of a meeting to review all the changes in our addendums to our contracts. This doesn't include our new 9 page contract that was effective 01-01-11. They have actually made the Offer to Purchase and Contract a little easier to understand and explain to clients.

The biggest change is doing away with Option #1 with regards to inspections and other contingencies. Now everything is under the umbrella of Option #2 which requires a "Due Diligence Period" and a "Due Diligence Fee". The Buyer has the right to inspect and examine the home during the due diligence period which also includes the loan process if the buyer is getting a mortgage. Another important factor is if your client is getting a loan, you have to be in communication with the lender to determine when he thinks the loan will be approved for closing. This is all under the due diligence period, although you can extend the date by using the form Agreement to Amend Contract.

Also, if you had a sales contingency on the contract, that would also be part of the due diligence period. You can see where this would become tricky.

The buyer pays the seller a negotiated (if any) fee, for the right to determine if the buyer wants to proceed with the purchase of the home or terminate. Now the buyer can cancel the contract for any or no reason at all as long as it is in the due diligence period. He will also receive his Earnest Money Deposit back.

The Due diligence fee is nonrefundable if the buyer decides to walk during the due diligence period but is added to the buyer's side for credit if the contract closes.

I'm confused just talking about it! Anything new is uncomfortable until you get to know and understand it. That is a snippet of what has changed in the forms for 2011. Your always on a learning curve and that can be very challenging if you happen to HATE CHANGE!

Since moving is listed as one of life’s major stress factors, doing your homework and planning ahead can dramatically help take the edge off feelings of anxiety, being overwhelmed and the “deer in the headlights” paralysis that often arises.

The further away on the calendar your move is, the less stress you are likely to be feeling. This is the time to start planning your move. Don’t be in denial about it or put things off that will cause you unnecessary stress. Start with the date that you want to be in your new house and settled.

First thing is if you own a home, do you want to sell it or rent it? Start lightening the load by weeding out the things that you won’t be bringing with you to the new location. Ask a reputable realtor to come out and give you info on the market in your area as far as pricing, time frame, and renting vs selling. She is a professional and should be able to supply you with the info you need to make your decision and to take Step 1 in the move.
