I received an offer on one of my listings the other day.

The offer includes a “sale of home contingency”, the buyers need to sell their residence in order to use the proceeds from their sale to purchase my listing.
I’m told that there is a contract on the buyer’s home and that the buyer’s home is officially under contract / out of attorney review. Therefore, the contingency is really a “closing of title contingency”.
In these circumstances, I feel that a copy of the contract for the buyer’s home and their buyer’s financing qualifications is needed.
Lately, I’ve had resistance in receiving copies of back/supporting contracts. Agents have responded that there are privacy laws, the 2001 Patriot Act, blah-blah-blah!
So, when I receive an offer like this anymore, I request the contracts be sent directly to the attorneys, so that it can be looked at during “the attorney review period”.
We go ahead and sign the offer, submit it to both the seller’s and buyer’s attorneys for their review, and I give both attorneys a heads-up.
After several requests, a copy of the contract on our buyer’s residence finally came in, but without the financing qualifications.
We still need to know that our buyer’s buyer is qualified to buy that house, so that our buyers can purchase this house!

My client’s attorney was on board and would not agree to conclude the attorney review on our transaction until we received the buyer’s qualifications.
Finally, a copy of the letter from the lender came in and they are qualified. (So far, so good)
But funny thing, the qualification letter from the lender was dated TODAY, which means that it did not exist during their review period.
But, what if they weren’t qualified…
I fully understand and respect privacy and people's rights to them, however...
I feel that sellers have a right to see buyer’s back contracts and the financing qualifications that go along with it.
“Anything” that affects the sellers contract, needs to be disclosed and available to the seller.

SHARE THE JOY!
One of our local radio stations, 100.1 WJRZ & Investors Savings Bank will unite again for the 10th annual live broadcast of "Share The Joy,"
DATE: Friday & Saturday, November 20th & 21st, 2009
LOCATION: Walmart, 950 Rt. 37 West in Toms River, NJ
Being collected will be food, towels and blankets for our four legged friends on behalf of the Jersey Shore Animal Center.
This includes an effort to fill a tractor-trailer with non-perishable food items, gently used clothing, new unwrapped toys, as well as monetary donations - all to benefit Ocean County Hunger Relief & Big Brothers Big Sisters.
At 6 am on Friday the 20th, 100.1 WJRZ will begin accepting donations while having a live broadcast on location. The broadcast will go on through the weekend and will end when the tractor-trailer is full.
Pre collection drop off sites are located at Investor Savings' Branches, Route 37 West in Toms River and North County Line Road in Jackson.
Clean out your closets and pantries. There's got to be some stuff you haven't used in some time, which will assist a pet or family in need.
