Watch out for Illegal Real Estate Fees!

What do you get from paying real estate fees?

Because of our experience in Real Estate we see a lot of things. Many times we have gone to a closing where the other people were charged a mysterious fee by their agents and brokerages. We have always wondered what this fee is? What is that for? Sometimes the fee is a legal fee mandated by a broker. Other times however, this fee is illegal!

Sometimes the broker or the agent doesn't even realize that they are charging their clients an illegal fee. They may justify their fee by citing many other brokerages who have it or by claiming that the fee has been around for a long time. The idea that a lot of people are doing something does not make it legal.

Most real estate brokerages have a commission and some will charge an additional $150 to $250 fee. This $150 to $250 extra fee could be a junk fee. Recent legislation has been passed to crack down on these junk fees. Washington Post columnist Kenneth R. Harney reported "In a decision late last month that is sending shudders through the realty brokerage industry, U.S. District Judge Virginia Emerson Hopkins in Birmingham, Ala., ruled that when a realty firm charges clients an 'admin' fee, for which no specific settlement services are performed, the fee violates federal law,".

How do you know you aren't being charged illegal bogus fees? First rule of thumb: only agree to a set commission with no other fees. If there are other fees, you might want to get a second opinion. Second rule of thumb: go with someone who is credible that you trust and has extensive experience.

Here is what else is going on with the market:

We are on track to be 25% lower than last year. This is Good News for Buyers!

In January 2008 there were 645 homes sold. This January there were 447 sold. Sales for 2009 were 31% lower than they were a year ago. In February 2008, 766 homes sold. This February 553 homes sold. In February the sales were only 28% lower than last year. In 2008 there were 966 homes sold in March. This year, there have been 670 homes reported as being sold so far. It is anticipated that this number will increase to 725 by the time all the sold homes are recorded. This will mean that sales are only down 22% compared to last year. Here is that information in a table:

There were about 1200 homes under contract in March and 725 of those are estimated to have sold. That is a 60% sell rate once the homes are under contract. Currently there are 1408 homes under contract. Based on last month's percentages we should see 850 homes sell. This number may be even higher because of the steadily increasing market!!

Irony of Free Money. Up to $28,000 free grant money up for grabs!

The housing burst has been blamed on the ability to buy a home with 0 money down. As the politicians blame the mortgage industry for giving away loans with no money down, the lenders create rules so that you need money down. Now the economy is doing worse so the politicians create funds for Free money to put down on a home. I can help anyone buy a home owner occupied for as little as 0 money down. Is the cat chasing its on tail? Possibly, but the early bird is going to get the worm today.

Although it seems to be an intriguing thought, I will continue to have fun helping people grab the free money. We know of an accounting company that can help buyers use the $8000 tax credit as a source of down payment on a home. We also have a government grant here in Utah where you can get $6,000 for buying a new home. And there is another grant for $5,000 for first time homebuyers.

Want free money? Go for the gold and possibly get $19,000 toward your home. We know of other programs as well where you can get $15,000 free grant money. You might just be able to ge up to $28,000 free grant money. Grab it while you can!!

What is the Utah Home Run Grant?

A lot of people are asking me about the new $6,000 Grant.

Here are the basics:

The Home Run Grant offers $6,000 to home buyers who purchase a never-occupied residence in Utah.

The grants are available on a first-come, first-served basis.

There are only 1,600 grants left and they're going fast. The approximate number of remaining grants will be posted on the UHC web page at www.utahhousingcorp.org.

Home buyers must meet the following income restrictions to be eligible: Single person, $75,000 Married couple, $150,000

You do NOT have to be a first time home-buyer

The $6,000 CAN be combined with the new $8,000* federal tax credit!

*The $8,000 federal tax credit is only available to first-time home buyers.
