These days many agents are willing to do whatever it takes to make a deal happen. One form of negotiation I have seen quite a bit lately is agents reducing their commissions to make a deal happen. Generally a selling agent will suggest reducing the buyers' agent commission to reach a desired deal.
Does this sound ok to you? This is a clear violation of the National Association of Realtors Code of Ethics as addressed in Standard of Practice 3-2 and 16-16.
Standard of Practice 3-2
REALTORS® shall, with respect to offers of compensation to another REALTOR®, timely communicate any change of compensation for cooperative services to the other REALTOR® prior to the time such REALTOR® produces an offer to purchase/lease the property. (Amended 1/94)
Standard of Practice 16-16
REALTORS®, acting as subagents or buyer/tenant representatives or brokers, shall not use the terms of an offer to purchase/lease to attempt to modify the listing broker's offer of compensation to subagents or buyer/tenant representatives or brokers nor make the submission of an executed offer to purchase/lease contingent on the listing broker's agreement to modify the offer of compensation. As agents and brokers we are not to become a party in the negotiation, we must remain at arm's length.
If you have done this in the past, stop. If you have not yet, don't.
Smaller Homeowner Relief Already In Place

Don't wait for home owner bailout provisions to trickle down from the $700 billion Emergency Economic Stabilization Act of 2008," (H.R. 1424) recently rushed through Congress. When it comes to help from new federal legislation for distressed home owners, the $300 billion "Housing and Economic Recovery Act of 2008" (H.R. 3221), signed earlier this year, can provide more immediate relief. The $300 billion recovery act has both a mandated mortgage modifying provision and a voluntary "Hope For Homeowners" (H4H) refinance program, for home owners who qualify.
In part, the stabilization act calls for federal agencies holding mortgage and mortgage securities to identify loans that can be modified and work toward modifications. And the stabilization deal calls for shoring up the H4H program. How any of those provisions will be implemented, however, is still under consideration.
