AGENCY RELATIONSHIPS
When real estate professionals work with sellers and buyers, "agency" relationships are established. As
you start working with a real estate professional, please ask for a clear explanation of the current agency laws in [your state or province], so that you understand these important issues.
There are three kinds of agency relationships:
• Buyer's agent: A "buyer's agent" represents the buyer during the home buying process. The buyer's real estate professional (agent) has a fiduciary responsibility to represent the buyer's best interests including reasonable care, loyalty and confidentiality.
• Seller's agent: A "seller's agent" represents the interest of the seller and has a fiduciary responsibility of reasonable care, loyalty, confidentiality and disclosure to the seller. A seller's real estate professional (agent) works to assist the seller in locating a buyer and in negotiating a transaction suitable to the seller's specific needs.
• Disclosed dual agent: A "disclosed dual agent" represents the interests of both the buyer and the seller, during the same transaction. A dual agent has responsibilities to both buyer and seller and must act in the best interest of both parties.

The Re-List for Free Guarantee
It's time to make your move. As one leading real estate brokers in the Hudson Valley for almost 25 years, we have seen these ups and downs in the market before, and we know that real estate goes in cycles. We believe that this market provides great opportunities for savvy buyers: rates are at all-time lows, inventory is high, and prices have come down significantly for over three years. This is a great place to live, and over the long-term homes in our area provide a tremendous investment opportunity.
So we're willing to make you this guarantee:
If you buy a home with a Prudential Rand Realty agent by March 31, 2009, and that
home goes down in value by the time you sell it, we will re-list it for free.
It's that simple. We know this is a great time to buy, so we are putting "our money where our mouth is." If you are in contract to buy a home through a Prudential Rand Realty agent by March 31, and your home goes down in value by the time you sell it, we will re-list it without charging a listing commission.
It doesn't matter if you sell it next year, three years from now, or 20 years from now. We've been here for 25 years, and we'll be here for many more. We're committed to the people and communities of Westchester and the Hudson Valley, and we believe that our best years are still to come.
Conditions:
We want to make sure you understand that the "Re-List for Free Guarantee" "Make Your Move" Program has a few simple conditions:
1. You must be in contract by March 31, 2009. You don't need to close by then, but you have to have signed contracts at that time.
2. Your purchase must be for your personal residence. We are not offering the guarantee for investment properties.
3. When you buy, the seller has to pay us a buyer-side commission.
You will receive a Re-List for Free Agreement that will set out these terms and conditions, which we will sign and give to you.
Frequently Asked Questions
Why would you do this?
We're doing this because we believe that the local real estate market is near its bottom. Prices have come down in most places for over three years, and are over 10% down from their heights. Although prices still might come down for the next year or so, we firmly believe that people buying homes right now will see appreciation by the time they sell. In other words, we are confident that you are making a smart decision to buy at this time, and we are willing to "put our money where our mouth is."
Do I have to hold my property for any period of time?
No, the promise is good from the day you go into contract until you sell, whether it's next year, in five years, or in 25 years.
Why do I have to be in contract by March 31, 2009?
We believe that now is the time to make your move. Like all promotions or programs, it's only good for a limited time.
How does the program work?
It's very simple. When you meet with your Prudential Rand Realty buyer agent, he or she will present you with the "Re-List for Free" Agreement along with our standard buyer representation agreement. When you buy something through us, we'll keep a copy of that Agreement on file. When it comes time for you to sell, just contact us and we'll make sure you're covered under the "Re-List for Free" Agreement. If you sell your home for less than what you paid for it, then we'll waive our listing side commission.
What if I lose my "Re-List for Free" Agreement?
We will keep a copy of the Agreement on file, just in case you lose it. Even if we both lose it, we'll honor the promise for our purchasers who get into contract between January 9, 2009 and March 31, 2009.
So if my home goes down in value, I won't have to pay a commission when it sells?
You won't have to pay a listing commission, but we'll encourage you to offer out compensation for cooperating brokers. Remember that real estate transactions are two-sided: one broker is on the listing side, and the other broker is on the buying side. When you re-list with us years from now, we will re-list your home with the understanding that if it sells for less than what you paid for it, we will waive our listing side commission. But you're still going to want to offer a commission to cooperating brokers, to incentivize them to bring you their buyers.
We're buying right now, but we're also listing our home with you. Will you waive our listing commission if we sell our home for less than what we paid for it?
We're offering the "Re-List for Free" promise to our buyers, so you'll get the benefits when you sell the home you're buying. But we can't offer it retroactively to people who bought years ago, when we weren't offering the program. But remember that this program is designed to help create confidence in the real estate market, and if we are successful then the program will help you as a seller.
Do you think it's a bad time to sell?
That depends on your situation. If you don't need to sell, and you're just testing the market, then you should probably stay out of the market. But if you're selling your current home to buy a new home in this market, then you're neutral to the market: you might be selling for less than you'd like, but you're probably buying at a great price. And if you're selling your current home to move to another area in the country, you're probably doing great, because many other parts of the country have seen larger sales price declines than our area. The bottom line is that if you don't need to sell, don't sell. But if your plan is to wait for the market to come back, just remember that it might take a few years. We're confident that the market will rebound, but we're taking a much longer view of the market.

When our marketing efforts bring a purchase offer, I will Negotiate the agreement
• Explain the offer to you and answer your questions.
• Help you determine the best course of action by pointing out potential advantages and disadvantages of the offer and clarifying the choices available to you.
• Prepare an Estimate of Net Proceeds based on the proposed price and terms.
• Negotiate through the buyer's agent, and handle possible counter offers, to reach a final agreement that is favorable to you.
Complete the transaction
• Explain to you in detail all the steps that will occur for a successful closing, and answer any questions you might have.
• Work with the buyer's broker, settlement officer, title officer and others to help coordinate their activities and keep the transaction moving forward.
• Monitor progress of inspections, the buyer's loan and other contingencies as called for in the purchase contract. Resolve questions or problems that might arise, in order to ensure a timely closing.
• Accompany the buyer and buyer's agent during their final walk-through of the property.
• Assist you in handling details required for the completion of the transaction.
• Communicate with you on a regular basis so that you can stay informed and is worry-free as possible.
Follow up after the sale closes
• Confirm that all your real estate-related needs have been met, and provide information on service providers you may require.
• Offer relocation assistance, if moving to a new area.
• Help you locate a new home, if remaining in this area.
