Should a Northern Virginia Short Sale Buyer Go to Settlement Without Seeing the Approval Letter?

This was a question I received in my email today. The answer to this question is simple.

NO WAY!

As a Buyer in a Northern Virginia Short Sale transaction, the Short Sale contingency in the contract is not removed until you see the Short Sale approval letters. And that means that the Seller could still back out with that contingency in place.

Furthermore, even when you do see the approval letters, you need to make sure they meet the definition of approval per the contract. In Northern Virginia, if the Seller is required to bring any cash to enhance the net proceeds to the Short Sale Bank, or the Short Sale Bank is reserving the right to pursue a deficiency judgment against the Seller, then the Seller can walk at the settlement table and you are left without a home.

Any Buyer that is getting a loan on the purchase of the Short Sale will need to provide that Short Sale approval letter to the lender to get the loan approved. And the title company issuing the title policy will also need to see the approval.

Finally, there may be terms and conditions of the approval that affect the Buyer, particularly if they are an investor. For instance, if an investor was purchasing a Short Sale with the intention to sell it to another Buyer in the short term, the approval letter may prohibit a resale within a certain time frame. An investor needs to know that before they get to the settlement table.

Any Short Sale Listing Agent that is NOT providing the Short Sale approval letter to the Buyer prior to settlement is either blissfully ignorant of the fact that they haven't, or should, provide it OR they may be hiding something. Whatever the case, as a Northern Virginia Short Sale Agent, I would advise any Buyer to see the Short Sale approval letters as soon as they are available.

In 1820 it only took 50 acres to establish Brentsville and make it the county seat of Prince William County. As residents moved farther west to work new farmland the existing county seat at Dumfries was too far east to serve them easily. Brentsville was a logical choice since it was centrally located along the major east/west road that went as far as the Shenandoah Valley. When the county seat moved to Manassas in 1893 Brentsville was able to maintain its' 19th century rural trappings.

In 18th and early 19th century rural Virginia the courthouse was the dominant power in county government. Today, the Brentsville Courthouse Historic Centre covers 28 acres along Bristow Road and includes five buildings and numerous archaeological sites. A visit to the beautifully maintained site will provide both an educational and relaxing way to spend a day learning about the early history of Prince William County.

Good Thing This Dryer Vents Into The Attic, Cause It Sure Can't Vent Outdoors!

Good thing this dryer vents into the attic, cause it sure can't vent outdoors!

Combine a makeshift laundry room, with a holey (not holy) dryer vent, and the most interesting, but clogged, discharge outdoors I have ever seen and what do you have?

Well, for one thing, you have a lot of mold!

Interestingly, most of the mold was not near the dryer vent!

Most of the exhaust was blowing so much toward one end of the house, the end where the homeowner covered up that pesky vent hole on the side of the house, that the mold really developed there! It was obvious that all that fresh, cool air getting into the attic space needed to be discontinued, in favor of warmer air from the dryer!

But there was enough exhaust blowing upward that the mold was happy here near the vent tubing too.

And it's a good thing.

No way could any air from the dryer get outside!

Cute, cute, cute!

It looks like a little alien hopping around on the roof!

That convenient grill works very well at blocking lint so that no exhaust can get out.

You can see there are two layers of shingles, and this roof collar was just nailed and glued on top with what I call goop! (yes, same house...)

To get that gentle curve on the metal tubing, the homeowner actually cut off pieces and taped the sections together!

This guy was good!

I hope it doesn't snow too deep!

Well, no matter if it does. There is all that attic space to hold the exhausting air.

My recommendation: if you see what looks like a makeshift laundry room, jammed into a linen closet, you can bet that everything else will be makeshift too! And you can COUNT on problems all along the way!
